Research On The Exhaust Inspection And Maintenance System Of In-use Vehicles In China

With the development of the national economy,the quantity of motor vehicles is also increasing.The emission of motor vehicles is becoming one of the main sources of air pollution,which affects people's health and is not conducive to the sustainable development of economy and society.The control of emissions from in-use vehicles is a key link in reducing emissions from vehicles.It requires the attention of governments,enterprises,and car owners.By drawing on the legislative experience of in-use vehicle emission control abroad and various treatment methods for in-use vehicle emission pollution,the in-use vehicle exhaust gas inspection and maintenance system is recognized as an effective means to control in-use vehicle emission pollution.Through sampling inspection?maintenance of high-emission vehicles detected by the screening,motor vehicles that exceed the standard need to pass the re-emission inspection before they can go on the road,forming a closed-loop management of motor vehicle control.The vehicle inspection and maintenance system has long been reflected in China's motor vehicle control laws,and is very similar to the "regular testing,mandatory maintenance,and repairs as appropriate" in the early domestic vehicle maintenance systems.It has always been formulated in China's motor vehicle emission pollution prevention laws and regulations,and the inspection and maintenance system has gradually become the main legal means for monitoring China's vehicles-in use.However,in practice,China's in-use vehicle inspection and maintenance system has also faced many problems,such as insufficient legislative basis,multiple regulatory systems and so on,which have affected the implementation of the in-use vehicle inspection and maintenance system.This article takes the in-use vehicle emission inspection and maintenance system as the entry point to control the in-use vehicle emission pollution,and systematically discusses the main content,legal provisions,and legal relationships of our in-use vehicle inspection and maintenance system,analyze the main problems faced by the current implementation of China's vehicle inspection and maintenance system and propose corresponding legal countermeasures.By perfecting China's existing vehicle emission inspection and maintenance system,we can better reduce the exhaust pollution of our vehicles-in use,promote sustainable economic and social development,and build an ecological and civilized society.The first chapter of this article introduces the current status of emissions from in-use vehicles in China,the necessity of implementing the emission inspection and maintenance system for in-use vehicles and briefly discusses the legal interpretation and theoretical basis of the emission inspection and maintenance system of in-use system.The second chapter combs the legal relationship,legal norms and main contents of the system of emission inspection and maintenance of in-use vehicles in China.The third chapter is based on the current implementation of China,drawing on and summarizing the experience of foreign legislation.The fourth chapter analyzes the legislation,supervision,and institutional building and other problems existing in my country's emission inspection and maintenance system.Chapter V,according to the actual situation and problems of China's in-use vehicle emission inspection and maintenance system,from the aspects of improving the legal system,supervision system,inspection and maintenance unit management and other aspects,put forward countermeasures to strengthen my country's in-vehicle emission inspection and maintenance system.
