Analysis On The Inplementation Problems Of "River Chief System" And Its Rule Of Law

River Chief System,a system of coordinated management of river basin,which is the head of the local party and government to serve as the river chief,water resources protection,water shoreline management,and water pollution prevention are supervised and coordinated by the river chief,relevant authorities areurged or suggested to perform their duties.It started in the Taihu Lake cyanobacteria event in Wuxi,Jiangsu Province in the summer of 2007.Later,this systemwas imitated by other places.The General Office of the CPC Central Committee and the General Office of the State Council released the "Opinions on the Full Implementation of the River chief System" at the end of 2016,requiring national promotion and implementation of this system.At this point,the system that started at the local level officially rose to the national strategy.On the one hand,the implementation of the river system has indeed achieved some good social effects.On the other hand,it also faced some difficulties in the course of implementation.The cracking of these problems requires us to reflect from theory to practice.As a river basin coordination governance system.The emergence and development of the river system has its legal basis behind it.By studying the relevant theories,development status and field research of the river system,and sorting out the current laws and regulations related to water in China,this paper believes that China's river system is facing the following problems in the process of inplementation:The division of water environmental protection rights between governments at all levels is unscientific and irregular;The nature and status of the organization is not clear;There is a logical dilemma in the evaluation mechanism of the river chief system;the logic system dilemma exists in the river accountability system.The most fundamental problem is that the division of water environmental protection rights between governments at all levels is unscientific and non-standard.The difficulties faced in the implementation of the river system require us to find out the causes behind it in time.This paper argues that the limitations of the local decision-making system and the promotion of the system are more due to the administrative method rather than the rule of law,the lack of public participation,and the weakening of the external supervision mechanism.Some suggestions for improvement are put forward,based on the basic understanding of the problems faced in the implementation of the river system and the causes behind it,in order to solve the problems in the course of implementing the river system,promote the formation of the river chief as a long-acting mechanism.The most important of these is the rational division of environmental protection rights in intergovernmental water bodies.In addition,clarifying the status and nature of the organization and optimizing the institutional setup,which is essential to standardize the implementation of the specific system of the river system and improve the system of the legal system of the river system.
