Although the mechanism of the engineering claim is sufficient,the contractor can solve the problems encountered in the construction process through the claim,but it is undeniable that due to the particularity of the commercial real estate,the contractor remains in the process of claiming the commercial real estate.There are more obvious problems.The reason is that the contractor's knowledge of claim management is still not high.The characteristics of commercial real estate are unclear,and the process of claim is still unfamiliar.The conflict between the interests of both parties is an important reason for the intensification of conflicts between the two sides.Therefore,it is necessary to conduct research on the claim problem to help the contractor solve the problem.This paper first analyzes the background of the claim,the purpose and significance of the research,the status quo of the claim,and introduces the relevant knowledge of game theory to find a theoretical tool suitable for solving the claim problem.Secondly,this paper analyzes the status quo and dilemma of WD commercial real estate claim,determines the research scope of this paper,analyzes the particularity of WD commercial real estate from the three aspects of construction period,construction and contract,and based on the typical commercial real estate claim of Fushun,Liaoyang and Ba yuquan WD.The card is sorted out,and the distress of claims such as strategic cooperation mode,construction period and management responsibility,and subject considerations are analyzed.Thirdly,the multiple bargaining model and the repetitive game model are used to analyze the behavioral decisions of the owner and the contractor in the claim,and determine the optimal claim amount and claim plan.Finally,the actual case of WD commercial real estate claims proves the rationality of the model and can help the contractor solve the claim problem.According to the analysis results,the conclusions are as follows:firstly,the compensation amount of one-time cooperative claims is lower than that of long-term cooperative claims;Secondly,in the process of claim negotiation,the contractor should not disclose the expected claim amount too early;Thirdly,the contractor needs to be patient with the claim and makes a scientific and reasonable estimate of the discount factors of both parties,so as to obtain more benefits from the claim.Therefore,if the contractor wants to maximize the claim amount,it needs to establish a long-term cooperative relationship with the owner,do not expose the expected claim amount prematurely,be patient with the claim,and conduct many scientific and reasonable negotiations to achieve its purpose.This paper can provide WD commercial real estate claims with efficient and optimal value solutions,which is conducive to the good cooperative relationship between party a and party b.it provides a method or solution to WD commercial real estate claims,and provides a reference and a way for the settlement of similar project claims in the future.
