With the rapid development of science and technology,technological innovation has become the driving force for the development of enterprises.Today,with the increasing trend of globalization,more and more enterprises have been impacted by the wave of globalization.In order to seize the market,enterprises need to constantly push through the old and bring forth the new,and actively carry out the research and development of new products.However,with the increasing improvement of intellectual property law,industry leading enterprises begin to carry out patent layout in advance through technological advantages,forming patent barriers and compressing the living space of backward enterprises.In the past,traditional backward enterprises can achieve the purpose of "corner overtaking" by means of imitation and reference,but with the continuous formation of patent barriers,backward enterprises can no longer rely solely on imitation and reference to increase their market share.In order to deal with this situation,patent circumvention design as a strategy to deal with patent barriers arises at the historic moment.The new products designed through patent evasion can not only enable enterprises to gain advantages in the market competition,but also improve their own R & D level and enable enterprises to embark on the road of healthy development.At present,the research on patent circumvention design is mainly based on the classical innovation method TRIZ.As a classical innovation theory,TRIZ has a good combination with patent circumvention design.However,the use of TRIZ is more complex,and it is difficult for users to form an intuitive understanding.In view of the shortcomings of the current patent evasion design,this paper proposes a patent evasion design process based on EVIT and applies it to the research of self-driving vehicles.The main contents of this paper are as follows:(1)Find out the logical relationship between EVIT and patent circumvention design,and introduce the concepts of patent elements,innovation dimension and innovation rule into patent circumvention design in EVIT.(2)Based on the innovation dimension,through the extraction and classification of the patent technology elements in the patent literature,combined with the summary results of the patent elements,the innovation dimension is used to find out the blank dimension in the current design,and the innovation rule is used to transform the blank dimension or the existing patent elements,and finally a new technical scheme in line with the legal standard is obtained.(3)Through the analysis of patent evasion examples of self-driving vehicles,the current research hotspots in the field of self-driving vehicles are found,and the breakthrough points of patent avoidance design are found through the analysis of the distribution of patent elements.Finally,the determination of patent infringement combined with the actual patent application of self-driving vehicles proves that EVIT is simple,fast and effective in patent avoidance design.By studying the method and application of patent circumvention design and combining a large number of patent literature,this paper combines EVIT with patent circumvention design in a scientific way,which provides an effective patent evasion design scheme for patent evasion designers,which not only promotes the theoretical construction of patent evasion,but also provides strong support for the development of domestic self-driving vehicles.
