| The construction project series contract is the code of conduct for the project construction unit and participating units(design unit,consulting unit,geological exploration unit,construction unit,etc.),and its content determines the risk distribution proportion between the parties to the contract.In reality,after long-term practice,the participating units have accumulated rich experience in contract risk management,and are good at using the construction project series contracts to safeguard their legitimate rights and interests,while the construction units still rely on their position advantages and neglect the contract risk management,which is easy to cause their own losses.Therefore,the construction unit must attach great importance to the standardization of the construction project series contract management,so as to improve the efficiency of the project management of the construction unit quickly and effectively.This paper takes the industrial park project of L company as an example,analyzes the current situation of construction contract management of L company from the perspective of the construction unit,summarizes the shortcomings of its construction contract management,and then puts forward real and effective solutions,in order to strengthen the standardized contract management,safeguard the interests of enterprises,and improve the market competitiveness of enterprises.This paper will first use the literature research method,library and network to consult the domestic and foreign construction contract related laws and regulations literature,to make materials and theoretical preparation for further research;secondly,through the observation method,it will carefully observe and summarize in the process of cooperation and communication between the company’s employees and the business contacts with the relevant personnel of the contract unit.At present,the company lacks the early warning mechanism of contract performance risk in the contract management,the contract file management is not standardized,the contract text is not precise,there are problems of construction period delay,frequent contract changes in the performance process,etc.are analyzed and summarized.Finally,through case analysis,the reasons for the problems in the project contract management of L company are analyzed,which are mainly the frequent changes of project management personnel The contract supervision mechanism is not in place,and the industry sensitivity is lacking as a whole.In view of the above problems,combined with the actual business situation of L company,this paper optimizes and improves the contract management problems encountered by L company from the aspects of improving the fine model of contract management,strengthening the construction of contract management system,and procedural control of contract management. |
