A Report On The E-C Translation Of International Construction Contract Law(Excerpt)

With the deepening of economic globalization,economic and trade cooperation among countries is becoming more and more frequent.Therefore,the scope of international trade is expanding and the number of international projects is increasing consequently.In international engineering,to achieve their respective goals,through signing up the contract and obeying it,the project participants cooperate with each other with their obligations,responsibilities and rights embodied in the contract.In other words,contract is the basis in the implement and completion of international construction,which further demonstrate the importance of getting acquainted with the knowledge of law when signing up a contract.And therefore the importance of legal translation in foreign trade and foreign legal exchanges is easy to be seen.The thesis uses the second chapter of The Intrnational Construction Contract Law,written by Lukas Klee,a law expert in the domain of international construction contract,as the source text.The chapter illustrates main difference of key contract affairs in the context of civil law and common law;it also gives a detailed analysis of its interconnection,which provides participants in international construction the relevant information about contracts.In this way,contract administrator could manage the contract effectively so as to avoid controversy and disputes in international engineering and promote the smooth progress of the project.At the same time,under the guidance of Functionalist Skopos Theory,the author intends to analyze difficulties in the translation,find the solution and hence improve the capability in translating legal text.The report consists of four parts:task description,process preparation,case study and conclusion.Case study is the most important part.For this part,the definition of law terms and construction terms will be analyzed carefully at lexical level.Besides,the strategies of recasting,amplification and method of the change of the voice are also adopted at syntactic level to display sentence translation.In the conclusion,the difficulties of translators leave a deep impression on the author thus motivate me to improve translation abilities.
