Zheng Guozi's reform of "Casting Penalty Books" has always been a hot topic in academic research.Relevant research is mainly based on the records of Zuozhuan,Guoyu,Shiji and other handed down classics.However,these documents mainly record the relevant deeds of "Casting Penalty Books" of Zichan,but the records of its contents are not available.Therefore,there is still much research space in this respect."Tsinghua University Tibetan Bamboo Slips of the Warring States Period(Lu)" which was named "Zi Chan"(for brevity,hereinafter referred to as "Zi Chan" chapter)tells about Zi Chan's moral accomplishment and political achievements.The whole article can be divided into ten small sections on Zi Chan's ideas during the ruling period.The ninth paragraph refers to Zi Chan's "Three State Decrees" and "Three State Penalty" in Xia,Shang and Zhou Dynasties."Zheng Ling","Ye Ling" and "Zheng Penalty","Wild Penalty" have been formulated.At present,academic circles lack systematic research on them.This paper intends to make a theoretical description of the research of Zi Chan in Tsinghua bamboo slips,analyze and supplement the records of Zi Chan's criminal record in Zuo Zhuan and other handed-down documents,analyze the content and nature of Zi Chan's criminal record,and further study Zi Chan's thought of etiquette and law through the criminal record.This article is divided into four parts: The first part synthesizes the academic research results of Zi Chan,and makes a collection and interpretation of Zi Chan.The second part elaborates the background and concrete connotation of Zi Chan's "Casting Penalty Book" through the Chapter Zi Chan of Tsinghua bamboo slips and the records of classics.Zi Chan's "Casting Penalty Book" aims at saving the world and striving to strengthen it.The article clearly points out that Zi Chan's "Casting Penalty Book" can be divided into "Order" and "Penalty".They can also be divided into "Zheng" and "Ye",which originated from the three generations of Xia,Shang and Zhou dynasties.The third part looks at the relationship between Zi Chan's thought of criminal law and morality from Zi Chan of Tsinghua bamboo slips,and then analyses Zi Chan's thought of "concurrent etiquette and law".Zi Chan advocates the combination of virtue and punishment,and the complementarity of etiquette and law,giving priority to etiquette,supplementing punishment,and combining punishment with morality.The fourth part introduces the evolution of the criminal law from the Western Zhou Dynasty to the Spring and Autumn Period,and speculates on the literary nature of Zi Chan in Tsinghua bamboo slips.From the text style of Zi Chan,its Jin script has obvious characteristics.Although it was later converted into Chu script,it still retains more elements of Jin culture.The source of relevant historical events should be closely related to Zheng Shu,which is called "Zheng Shu" in the handed down literature.
