Translation Of Legal Texts From English To Chinese Under The Guidance Of New Textualism

Because of the misunderstanding of source legal texts,the distortion of laws after translation always occurs.In judicial system,as law language is characterized by its complexity,uncertainty and vagueness,judges need to extract certain legal meaning by some rules of legal interpretation when they apply laws.New Textualism,the main American statutory interpretation rule,helps judges accurately understand the meaning of laws.Meanwhile,in hermeneutics,translation is a limited interpretation,and legal translation and legal interpretation have a lot in common.Accordingly,this thesis explores the relationship between New Textualism and legal text translation,and some proper translation methods in conveying a faithful meaning of source legal texts and retaining the source legal effect in target legal texts are selected under the inspiration of New Textualism.In accordance with New Textualism,translators are required to respect the legal text and focus on the ordinary meaning and the coherence of texts so as to get accurate understanding of the source legal texts,maintain the legal effect,and compensate the deficiency resulting from language and culture difference.Under the ordinary meaning of New Textualism,literal translation is the first choice for the delivering of the obvious ordinary meaning of legal words and phrases.For some professional legal words and phrases coming from semantic changes,faithful translation can be applied to convey the precise ordinary meaning the text intends to express in a context.Under the guidance of the coherence of texts of New Textualism,through systematic analysis of legal texts,for some legal cultural words or vague expressions,semantic translation can provide cognitive compensation for target readers and enable target legal texts to be more clear and acceptable.Depending itself on the previous studies and exploring the translation for legal texts from the perspective of New Textualism,the thesis is innovative both to the field of legal translation and of legal herm eneutics..
