A Study On The Statutory Licensing System Of Poverty Alleviation

With the advent of the Internet technology,the acquisition of information is no longer a problem.However,the unrestricted access poses a problem for copyright protection.The rights of the copyright owner are challenged.To standardize the acquisition of works is undoubtfully one of the methods to alleviate the conflicts of interest between copyright owners and the users.In order to achieve the goals of helping the poor and protecting the copyright,every legal worker is subject to the responsibilities of creating innovating rules and regulations,which shall restrict the users' behavior.Legal permission of alleviating poverty is stipulated in Article 9 of the<Regulations on the Protection of Information Spreading on Network>in China.It defines the rights of copyright owners,who owns the work of poverty alleviation.However,in the course of practical application,the regulation pose too many limits,the range of application is too narrow,the desired results of its application was not achieved.Therefore,there is a need to improve and optimize it in the legislative and judicial level.In this thesis,the analysis of the purpose,structure,legislative contribution and judicial practice of Article 9 of the<Regulations on the Protection of Information Spreading on Network>is carried out.From the point of view of the limitations of the legal licensing system and the target value of the poverty alleviation on the internet,the legitimacy of the legal poverty alleviation is confirmed,the institutional theory and practice obstacles are analyzed,and the relevant solutions are purposed herein.It is therefore hope to shred lights in the perfection of legal systems of poverty alleviation through internet,and to assist the smooth practices of internet poverty alleviation.The contents are divided into the following four parts:Part ?:the basic theory of the legal permission system on poverty alleviation.First of all,it introduces concept of the legal system of poverty alleviation;followed by the basic characteristics and essential attributes of the legal system of poverty alleviation;finally,it analyzes the legitimacy of the legal system of poverty alleviation.Part ?:The Status and problems of China's legal system for poverty alleviation.First of all,the status of the legal licensing system for poverty alleviation in China;secondly,it analyzes the existing problems in the legal system of subsidy for poverty in China.Part ?:Extraterritorial practice of poverty alleviation legal permission system.First,the relevant provisions of the copyright licensing system in the international conventions are introduced;secondly,it introduces the relevant provisions of foreign legal system of for poverty alleviation;finally,the analysis and evaluation of extraterritorial practice are given.Part ?:the concrete conception of perfecting the legal permission system of poverty alleviation in China.First of all,the incorporation of legal permission of poverty alleviation in the<copyright law>;secondly,the implementation of "National Library Promotion Plan";thirdly,the construction the payment mechanism of our country's copyright legal system;finally,the protection measures of copyright.
