Research On Food Safety Rewarding Report System From The Perspective Of Economic Law

In recent ten years,food safety awarding report legal system has been developed well and achieved certain results.In China,31 provinces have issued more than a hundred relevant pieces of regulatory documents about food safety awarding report,including The food safety law of the People's Republic of China(2015).However,the food safety rewarding report legal system is still imperfect,the problems exposed in the process of building to be solved.From the legislative point of view,our national food safety rewarding report legal system in the lack of high-level legislation,The Food Safety Law is only a general rule,there are many conflicts in the legislation of the provinces.From the perspective of law enforcement,public participation is passive and lack of effective protection of informants,whose personal safety,property security and other rights related to the report can not be guaranteed.From the procedural level,the reporting process and rewarding procedures are so complex that informants is difficult to obtain rewards,which is not conducive to encouraging the public to actively participate in the governance of food safety issues.Based on the theory of economic law,this paper expounds the legal value of the reward system of food safety report in our country.At the same time,it examines both the legislation and the practice,analyzes its existing problems and combines the relevant systems of food safety governance in developed countries.Finally,this paper also attempts to establish and improve the conception of the rewarding report system of food safety in China,mainly including the improving the legislation,the establishment of basic principles such as the principle of safety and security,the principle of citizen participation and and other basic principles,improving the process of reward and report,strengthening the propaganda and education,perfecting the guarantee mechanism of the whistleblower rights etc..
