Application Of Project Management Theory In Family Trial

Comparing with the definition and characteristics of project,this thesis demonstrates that the family trial is a project.Because the family trial has characteristics of complexity and significance,in order to reduce the cost and risk of family trials and improve the trial quality,we shall introduce the project management into family trials.It proves that the family trial project management is a true proposition rather than a false proposition.Based on the demonstration of the necessity of family trial project management,this thesis analyzes four family trial groups:the collegial panel,mediation group,psychological counseling group,family trial after service project group,and puts forward some countermeasures and suggestions to the problems of human resource management for judges and jurors in a collegial panel,mediators in a mediation group.Compared with the common civil trial,there are great differences in process management and time management between the family trials and the ordinary civil trials because of the intervention of mediation,psychological counseling and family after trial service.Its complexity is much higher than that of the ordinary civil trial.Therefore,this paper studies the process management of family trials and recommends the use of Gantt chart to manage the time management of family affairs.The trial of ordinary civil cases emphasizes the pattern of adversary trial,but this kind of trial pattern may stimulate family contradictions and lead to the risk of family trial.And good and efficient communication is the key to prevent and dissolve the risk.Therefore,this paper discusses the communication management in the home affairs trial,and puts forward the relevant countermeasures and suggestions for communication management.In order to prevent the risk of family trials,this paper applies project risk management theory to risk identification,risk assessment,risk emergency measures and risk monitoring,where the court writ is the biggest highlight of risk prevention measures.Based on the recurrence probability of family conflicts after closing a family trial,family after trial service shall be strengthened,and after the end of family after trial service,we can evaluate the legal effect and social effect of the family case.This paper studies the ways and means of family after trial service,the evaluation methods of family trial' legal effects and social effects,and puts forward specific countermeasures and suggestions.
