The relationship between employers and workers in non-public enterprises is mainly presented as industrial relations.Started rom 1979,Chinese government constantly encourages and support the development of NPSOE(Non Public Sector Of Economy).From over 40 years' practice,the NPSOE has become a very important part of socialist market economy in China.It plays un significant role in social development,employment promotion as well as changing social welfare and urbanization.At present,all different kinds of NPSOEs has bearded 80% of urban population employment,but the inborn contradiction between employer & employee has gradually causes many problems in depth.The industrial relations present a phenomenon of “employers dominating over labors” which leads the violation of labor rights.This frequently happened in NPSOE since its neglecting CSR and One-sided pursuit of economic benefits.Since the increasing awareness of protecting labor rights,employees tend to collectively pursuing and maximizing their benefits which makes industrial relations more complicated and intense.In some enterprises like Honda and Foxconn,collective labor rights protection has happened consequently which causes the adverse effect in the sound development of NPSOE as well as the harmonious society.This article attempts to start with the key elements which causes the labor disputes,on the basis objectively analyzing different kinds of labor dispute characteristics,trends and causes,proposes corresponding suggestions and countermeasures on internal governance system,policies and regulations adjustments as well as the function of labor union.This research aims to efficiently improve the corporate management philosophy,perfect the government governance system,enforce the coordinating capability of labor union which will consequently plays a reference role in establishing a harmonious industrial relation among non-public enterprises so as to realize the “win-win” between “employers &employee”.This paper consists of 4 chapters:The first chapter is the introduction of this research.It presents the research background and analyzes the practical significance of theoretical research from three aspects of society,economy and culture.This paper comprehensively arranges the present research situation both domestic & abroad,summarizes the innovation and deficiency as well.The second chapter summarizes the relative concerns on the labor dispute in Non-public enterprises.Based on the change of China's Concept of non-public Economy,it puts forwards that the scope of current research on non-public enterprises should be extended to mixed ownership enterprises,individual economic organizations and private non-enterprise units.It is analyzed that the labor disputes in non-public enterprises in China are essentially contradictions among the people,without the attributes of class antagonism and confrontation.This article elaborates the different forms of the basic labor rights both domestic & abroad and comprehensively introduces the labor dispute coordination models in China.The third chapter presents the depth analysis of labor disputes among Non-public enterprises.Through four aspects of economic interests,labor contracts,labor protection and the demand for the disadvantaged groups in the non-public enterprises,it is specially pointed out that the current trend of collective action for the workers' rights protection is obvious,and it is changing the direction on the demand of sharing the development of the enterprises and the democratic political rights in the interest demands.Meanwhile,the rise of the “Internet+” industry has brought new challenges to the coordination and resolution of labor disputes.Detailed analysis has been conducted on the formation of these changing trends from different perspectives like benefit contrast,labor,enterprise,market,trade union etc.The fourth chapter points out the countermeasures and suggestions on the coordination of labor disputes among Non-public enterprises,especially from the perspective of utilizing the function of enterprises,government and labor union.Enterprises should strengthen internal governance and share the fruits of enterprise development with all staff and workers in a scientific way;The government should further improve laws and regulations,and strengthen the leading role in coordinating and disposing labor disputes;The labor union should give full play to their organizational & coordination advantages and plays a role in promoting labor-union construction,promoting labor and capital communication,strengthening democratic management,and improving the function of safeguarding rights and services.
