Study On The Protection Of The Rights And Interests Of Migrant Workers Under The View Of Rule Of Law

China's reform and opening up,the rapid development of domestic economy,domestic people's demand for roads,housing,electricity,schools,hospitals,water and other infrastructure is increasing,the labor force in the city can not be satisfied with the demand of labor,so more and more rural people have entered the city to contribute to the new city.At this stage of transformation,they are a new group of "migrant workers".The word "migrant worker" is a unique name of our country.It is the product of China's two yuan social structure in urban and rural areas.It is a kind of abnormal classification of the population caused by the existence of the household registration system.Migrant workers refer to a group of people who have entered the city from the rural areas.Compared to the Aboriginal people in the city,the migrant workers have a congenital disadvantage in the protection of rights and interests.It is precisely because of this disadvantage that China's migrant workers have long been in a state of rights and interests.The rights and interests of migrant workers can not be guaranteed,which will cause damage to the interests of migrant workers,and affect the survival state and mentality of the migrant workers,which is not conducive to the coordinated development of urban and rural areas and the maintenance of social stability.How to effectively guarantee the rights and interests of migrant workers,promote the improvement of the living standard of this special group,speed up the pace of urbanization in China,and promote the healthy development of society,economy and culture in the process of urban development is the key problem in the whole process of urbanization in China.In this process,protecting the legitimate rights and interests of migrant workers is an important part of achieving social equity and justice and deserves full attention.With the improvement of the national legal system and the increasing attention of all walks of life for the vulnerable groups of migrant workers,the living conditions of the migrant workers in our country have been greatly improved.However,considering the actual situation in China,the purpose of protecting the rights and interests of the special groups of migrant workers is still a long way to go and needs to be improved.The group rights and interests of migrant workers are still social discrimination,poor income security,lack of social insurance,children's equal access to school,unfair medical expenses,poor urban life and low labor income.The above problems have greatly affected the quality of life and the difficulty of survival of the group,resulting in a large degree of social injustice and influence.China's urbanization promotion strategy and the overall objective of building a well-off society in an all-round way.The formation of concept appellation for migrant workers began to appear in 1980 s and became one of the most important group vocabulary in the new century since the reform and opening up of the urbanization process.It is also due to the increasing number of people and the importance of social influence.In the more than 40 years after self formation,many scholars in the humanities,such as economics,law and sociology,have carried out research on the migrant workers,providing many suggestions for social fairness and justice stability,and making the migrant workers feel the feeling.To social care.Integrating these research contents and achievements,the classification of the rights and interests of migrant workers can be divided into economic,political,social and cultural aspects.In the discussion of protecting the rights and interests of migrant workers,the main bodies of the relevant authorities have different opinions.Most scholars believe that the central and local governments at all levels should undertake the main responsibility work.Some scholars have highlighted the role of trade unions,and think that trade unions,as protectors of workers' rights and interests,should undertake more tasks.The research achievements of predecessors in academia have provided many ideas,inspirations and experiences for the completion of this article.This paper,through the introduction of the origin,development and the evolution of the special group of migrant workers in China,analyzes the current status of the protection of the rights and interests of migrant workers in our country,combs out the achievements that the migrant workers have achieved in political,social,economic and cultural rights and interests,and summarizes the eighteen years of the party in the five years.On the basis of the new achievements of the protection of the rights and interests of migrant workers,and finding out the existing problems,and combining the fundamental reasons of these problems,this paper proposes to provide policy suggestions for the protection of the legitimate rights and interests of rural migrant workers in the context of the country's overall policy of strengthening the country according to law.
