Research On The Reform Of The Petition System In The View Of The Rule Of Law

Petition is the window of the party and the government to understand the public opinion,the focus of solving social contradictions,and the bridge to the masses.Petition,as an important contacting form of Party committee,government and the masses,was first seen at the beginning of the founding of the Communist Party of China.After nearly a hundred years of development,on the basis of constantly summarizing the experience of development and drawing lessons,the petition still plays an irreplaceable role.With the continuous development of the economy and society,the deepening of various reforms,and the continuous renewal of ideas,the contradictions and problems are becoming more prominent,the pressure on the petition is even greater.There are many new problems,new situations and new features in the work of petition at the grass-roots level.In the process of the reform of the petition system,how to effectively resolve contradictions and problems according to laws and give full play to the communication function of the petition,is of great significance for the Party committee and the government.Taking G city Z district as an example,this paper analyses of the typical cases of grass-roots petition work,elaborates the plight of the present work of petition,analyzes the causes of these plight.On this basis,the possible measures for the reform of the petition system under the rule of law are discussed.This article holds that in the view of the rule of law,we should reform the system of petition from the ideas,the legislation,the judicature and the administration.First,we should strengthen the propaganda and education of the rule of law and ideological reform,aiming to promote the concept of the rule of law of the masses,to help leading cadres formatting the correct view of political achievements,and also,standardize the leadership contract system to weaken the influence of the rule by man.The two is to establish the law of petition and to improve the relevant laws and regulations as soon as possible,so as to make the petition work in accordance with the law.The three is to improve the legal aid system and the system of judicial assistance to help the poor masses protecting their rights according to law.The four is to adjust the scope of acceptance,streamlining the appellate body,clear the scope of acceptance,and reduce the buck passing phenomenon.The five is to give the petition departments enough power to coordinate,supervise,investigate and affix the responsibility for,promoting the problem of petition solved in time.The six is to integrate the channels of petition,establish the information database of the petition,register and record the same matter,so as to reduce the repeated petition which is from multiple channels.The seven is to establish a third party supervision and evaluation mechanism for scientific assessments.We should focus on content assessment,such as resolving process normalization and resolving rate.We should set up a way of "solving problems in accordance with the law to achieve peace",correcting local leaders' wrong achievements view and local erroneous behaviors that deviating from the rule of law.
