The new Consumer Rights Protection Law of the People's Republic of China,which was implemented in 2014,formally stipulated that consumers have the right to retract from online shopping from the legal level.Subsequently,the State Administration for Industry and Commerce has also issued some supporting regulations to refine the relevant provisions of the right to retract.The appearance of consumer repenting rights in online shopping seems to violate the contractual strict principle,but it realizes the real freedom of contract because it makes up for the shortcomings of consumers in information acquisition and balances the position of consumers and operators in online transactions.But because our country consumer repents the right is introduced from abroad,so in the practice will inevitably appear various problems,for example: the scope of repenting right is vague,the time limit of exercising right is single,the relief measure is not perfect,the repenting right is abused and so on.This paper first studies the theoretical basis of the right of consumers to retract in online shopping,discusses the legal basis and necessity of its existence,and then draws on the provisions of the right of retract for consumers of online shopping abroad.This paper puts forward some suggestions on the shortcomings of the repenting right of online shopping consumers in China. |
