On The Administrative Accountability Object In China

Administrative accountability system is an innovation of our government reform,the key for establishment of responsible government, and also the important form ofdemocratic polities. The administrative accountability has been generally concernedby governments and the public in nearly ten years since the "accountability storm"after "SARS" in 2003.The practice of administrative accountability in our country hasachieved great progress in the past ten years. A series of provisions on accountabilityhave been made by central and local governments. The concept of administrativeaccountability has been gradually rooted in people’s hearts, and the normaladministrative accountability in practice has been developing.Administrative accountability system generates from western countries, withricher theories and a longer history of practice. In comparison, its development in ourcountry is shorter, so there are various deficiencies. Accountability object is the keyelements of administrative accountability, the entrance to solve problems ofadministrative accountability in our country, and also the focus of this thesis.Administrative accountability object means "accountable to whom", including theadministrative agency and the officials.This thesis first introduces a research background, the theoretical and practicalsignificance of the topic selected, the research situation at home and abroad, andresearch methods. Then it determines the sense of accountability system,administrative accountability system and accountability object. In practice, there aresome dilemmas of administrative accountability object, including the narrow scope ofaccountability object, fuzzy boundary of responsibility, justice and objectivity problemof accountability, lack of legal basis, flexible and formal responsibility, lack of legalbasis, lack of right protection and relief, and imperfect mechanism of resurface and soon. This thesis takes the example of Meng Xuenong as a typical case of administrativeaccountability object, for analyzing those problems about administrativeaccountability object in this case and giving simple countermeasures. On the base of analysis as before, the thesis puts forward countermeasures which mainly include thefollowing aspects: attaching importance to the law construction, enhancing variantintendance, cultivating administrative accountability culture, attaching importance tothe right protection and relief, enhancing information disclosure and administrativetransparency.
