The Generating Logic Of Power Boundary Of Comprehensive Administrative And Law Enforcement Bureau Of Township

According to this analytical framework of "vertical interaction-horizontal interaction-political and social interaction",based on the cases of Comprehensive Administrative and Law Enforcement Bureau of Township(abbreviation for CABT),this paper focuses on the question that how the power boundary of Comprehensive Administrative and Law Enforcement Bureau of Township generates.Chapter one,from macro perspective,analyses the situation and causes of predicament in township administrative enforcement,and assesses current solutions.Then,two cases of research are presented,prepared for the following studies.Chapter two abstractly recovers the formation process of the power prototype of Comprehensive Administrative and Law Enforcement Bureau of Township.This article considers that Comprehensive Administrative and Law Enforcement Bureau of Township is the outcome of which empowerment requirements in township governments encounters inertia of control in county governments.The empowerment requirements in township governments originates from two kinds of behavioral logic,that is to expand its powers and to strengthen power.Of course," Political Opportunity Structure "provided by central government offers necessary conditions.However,due to the structural constraints of Pressure system,Upward responsibility system,and One-dimensional supervision,county government behavior under the inertia of control inhibits the release of effects of reform.Chapter three pays close attention to the further evolution of Comprehensive Administrative and Law Enforcement Bureau of Township,moving in the real space,consisted of horizontal interaction which orientates towards the inner level of power system movement,and political and social interaction that stresses the external dimension.During the part of horizontal interaction,we find that under the restriction of "Tiao-Kuai" constructure,with incomplete and not systematic reform,CABT doesn't reduce coordination costs fully compared to the previous.While,embedded in the overall power network,CABTs make efforts to shift to an earlier date of law enforcement,energizing for itself successfully.In the part of political and social interaction,based on the perspective of justification discourse structure,this study try to excavate the hidden intrinsic association between violence resistance and violence enforcement.We find that,under the existing political system,ethical "people"political discourse contradict rationalized legal discourse,which shapes the orientation towards of concept and entity separation.The tension between two contradictory justification discourse structure,provides structural factors for two faces of law enforcement of CABT,in other words,"civilized law enforcement" on the surface and de facto "violence enforcement".Chapter four concludes the whole chain of the generating logic of power boundary of Comprehensive Administrative and Law Enforcement Bureau of Township.Then,the paper gives the outlook of township comprehensive administrative law enforcement system reform.In the part of Conclusion,we respond to the related theory.The research indicates that township comprehensive administrative law enforcement system reform represents a type of reform,which come into being due of strong state autonomy structure.The key of success of reform lies in establishing an effective reform supervision mechanism.The analysis of vertical interaction and horizontal interaction demonstrates,township comprehensive administrative law enforcement system reform encounters the negative impact of institutional path dependence.The research reveals that changing the structure of the relationship between the state and society is the key of overcoming reform alienation and achieving state infrastructural capacity steadily promotion.
