Study On The Prevention Of Corruption In Village Cadres From The Perspective Of Sociology Of Law

Resolutely punishing and effectively preventing corruption,and the relationship between the people and the party's survival,is a major political task that the party must always grasp.Grassroots village cadres guarded the implementation of policy funds in our country at the end of the door,all support for subsidies in our country,capital management and distribution of work,and the requisition of large infrastructure project planning and implementation,village cadres can be involved.Over the years,although the government constantly more efforts to fight village officials corruption,and also made a lot of achievements,but village cadres spreading corruption is still not under control.The reason is lack of a set of overall,effective,in line with China's national conditions of village cadres corruption prevention mechanism.But the establishment of the village cadres corruption prevention mechanism is not a simple task,but a systematic project related to all aspects of the country.In the end,we should crack down on the corruption of village cadres and prevent the corruption of village cadres.To prevent corruption,we should and must establish a long-term mechanism to prevent the corruption of village cadres.In this article,through analysis of rural governance in the process of perfecting the village officials corruption prevention mechanism which vulnerabilities,and targeted in the process of rural governance in our country,village cadres at the grass-roots level of corruption prevention mechanism failure problem put forward the improvement of the corresponding mechanism and countermeasures.Generally speaking,there are several points:first,cultural factors,including the bad influence of traditional culture and the absence of rule of law culture in rural governance.Second,institutional factors,including power restriction,imperfect supervision mechanism,imperfect villagers' self-government system,unreasonable employment mechanism of village cadres and incomplete system of collective land ownership.Third,social factors,including the negative influence of clan power,villagers'legal concept and supervision consciousness are weak.For the specialty of village cadres identity,in the backdrop of the rural governance,this paper combined with the village officials corruption prevention theory,to construct village officials corruption prevention mechanism as the breakthrough point,from the perspective of legislative,administrative and judicial three countermeasure analysis,the main part of easy to cause the village officials corruption depth analysis,in order to improve the village officials corruption prevention mechanism,find healing.The specific countermeasures are:firstly,legislative countermeasures,perfect the code of criminal law,the organization law of the village committee,the village committee autonomy,and the legal system of the party.Secondly,the administrative measures should improve the administrative supervision and restriction mechanism of village cadres and improve the guidance of the township government.Thirdly,judicial countermeasures should clarify the corresponding jurisdiction functions of the investigation organs,improve the system of inspection and reporting,and give play to the function of the station and the social prevention function of the trial.
