A Research On Legal Issues Of Establishing Comprehensive Offices Between The Cross-Straits

Since Taiwan opened its door for the people to visit their relatives in the mainland China in 1987,the cross-Straits communication about people,economy,trade,culture and education have been getting closer and closer.As the communication reaches a certain width and depth,the corresponding demand mechanism for cross-Straits interaction will increase.Although currently the mutual administrative offices of tourism,economy and trade have been established in both Taiwan and the mainland,a comprehensive office is still in need considering their single-function.With the deepening exchanges in various fields across the Taiwan Straits,the number of issues that need to be negotiated keeps steadily increasing,as well as the difficulty.Especially for some unexpected events,both sides can't handle it as soon as possible because always be delay.Whereas,if a comprehensive office is set up,it will play a positive role in promoting the institutionalization of cross-Straits relations.At present,however,when negotiating about the establishment of cross-Straits offices,some institutional,structural and legal problems.They positioning and functions of the offices,and the legal basis of Taiwan and the mainland,which will severely influence whether the mutual offices can be established successfully.This mainly analyze the problems come across in the process of negotiating about the offices' establishment,and then learn from relevant experience at home and abroad,in order to ultimately resolve the existing problems when setting up mutual cross-Straits comprehensive offices.This thesis argues that the cross-Straits comprehensive offices can adopt the mode of Hong Kong officesin the mainland and the mode of the mutual offices established by SEF and ARATS.Since the two modes all provide comprehensive offices and the negotiation mechanism between SEF and ARATS is pretty mature,many problems in the process of communication can be reducedboth sides of the Taiwan Straits should perfect the corresponding legal system and ensure the legal basis of their offices.
