Since the policy of reform and opening to the outside world,under the influence of industrialization and urbanization,China's economy has been developing faster and faster.China's strategic goal is to build a well-off society in an all-round way by 2020.The 13 th Five-Year Plan is the decisive stage of building a well-off society.The subject of this study is the legal guarantee of the right to education of children left behind in Wuling Mountain.It is intended that through the present situation of Wuling mountain education,combining with the theory of guaranteeing the constitutional basic rights of citizens in the current legal field,a set of targeted measures to solve the insufficient protection of the right to education of children left behind in Wuling mountain area.From the perspective of empirical research,this paper uses normative analysis,documentary analysis,case analysis,comparative analysis,data analysis,empirical analysis,and so on to analyze the theoretical issues,and then discusses the theory of the right to education of left-behind children.The main contents of the thesis mainly explain the education status of children left behind in Wuling mountain area.This paper expounds the problems in the protection of the right to education of children left behind in Wuling mountain area,which are not perfect in legislation,general provisions of education legislation and unclear mandate.In the aspect of administrative guarantee,the educational administrative organs are weak in law enforcement,insufficient in financial investment and unreasonable in financial distribution structure.(B)The lack of judicial remedies in the judicial sphere;The third part briefly expounds the research of the main constitutionalist countries on the protection of children's right to education,mainly taking the United States and Nippon as examples.Combined with the main achievements of education of left-behind children in Central and Western China,this paper puts forward the guarantee of the right to education from three aspects of legislation,administration and judicature.
