Research On The Legal Issues Of Responsible Government Construction

China's promotion of her construction of rule of law was clearly presented as a new key policy target at the Third Plenary Session of the 18thCPC National Congress.The 19th National Congress further emphasized that deepen the practice of ruling the country by law,and made further demands on constructing the government under the rule by law,carrying out administration in accordance with the law,as well as executing civilized law enforcement strictly and normatively.With the limitation of China's current political and economic developing levels,there is still a long way to go to establish a legal government under law.However,building a responsible government,milestone of realizing rule of law in China,has more maneuverability in practice.There is something there worth studying theoretically and practicing actively.With the further improvement of our legal system,a responsible government will become the inevitable state of the rule of law in our country.It will also become the ideal governance state of the highly sound and effective legal system.The connotation of responsible government includes many aspects:limiting the power of government;assuring the process and results of government administrative actions are highly open and transparent;defining and implementing responsibility of the government;ensuring the government will respond people's legitimate appeals,legitimate rights and interests,and major concerns in time;even requiring the government to abide high ethical standard for its administrative act,for example honesty in administration.The paper is arranged in line with the idea of proposing problems,analyzing problems,and ultimately resolving problems.It studied the legal problems in the construction of responsible government.First,the paper put forward the necessity of the legal construction of the responsible government in China from the aspects of nomocracy government,popular sovereignty and public interest.It also analyzed the current situation,achievements and legal system of responsible government construction.In addition,it teased out the current dilemma of responsible government construction,including the imbalance status between its power and responsibility,the shortage of execution for administrative accountability,and the shortage of legal supervision of the administrative power operation.The paper made further analysis on the cause of the dilemma,found out the major causes of that which including the absence of traditional culture of law,the faultiness of governmental legal liability system,and the failure to form synergy on legal supervision system.On this basis,the article raised a series of measures such as strengthen the construction of legal system for government responsibility,government information disclosure,government accountability,government supervision and coordination system.Specific included strengthen the legislative construction of responsible government,cultivate the legal consciousness of government staff,promote the reform of judicial system,improve Regulations on Open Government Information and Evaluation System for Government Affairs,form a government accountability system with resultant supervisory force,promulgate the Administrative Accountability Law,enhance the construction of administrative system reformation and coordination mechanism,completed legislation and form a party-led,government-dominated,all-participated supervision and coordination mechanism,as well as improve the internal and external administrative supervision system.Hope the measures in this article could be helpful to promote the construction of responsible government in China.
