The report of the Nineteenth Congress pointed out that in order to strengthen and innovate social governance,it is necessary to create a social governance structure that builds a common governance and sharing.Community service is a kind of penalty,which obviously belongs to the legal category.However,compared with other penalties,it has significant social characteristics and belongs to the category of social management.It is one of the means for society to participate in criminal justice.From a practical point of view,the community service has the advantages of economy and high efficiency compared to the short-term imprisonment.Therefore,countries such as the United Kingdom and the United States have already begun to widely use community service as a means to punish misdemeanors.In 2003,China started piloting community corrections.After that,community service was introduced as one of the contents of community corrections.Community prisoners are required to participate in compulsory public welfare work that is not less than eight hours a month.Various localities have also actively issued community service rules,but overall the implementation is not optimistic.Through the investigation of the implementation of P-county community service,and comparison with other regions,it is found that the community service is still in the vacuum of legal supervision.Community service is still hard to implement.The study on the implementation of community service involving both the law and social management needs to be analyzed from both aspects.From a social point of view,our country's society has long been government-led governance system,and community development has been slow to develop in terms of judicial participation.As a result,the administration of community service is still carried out independently by the judicial administrative staff,and there is not much Social participation.From the legal point of view,"No rules no standards" we must standardize the implementation of the management of community service criminals first.We should also focus on community service in the criminal legislation.Many scholars have suggested that China should follow the experience of other countries and regions and transplant some of its experiences into the implementation of community service in China.The experience of other countries and regions has its advantages,but it does not fully apply to the special conditions of our country.Judging from social factors,most regions in China have not established mature communities and lack the foundation of implementation of community service.China belongs to the socialist legal system with Chinese characteristics and is not the same as the legal systems of other countries and regions.The introduction of laws of other countries and regions may affect the unity of the law.Through various research methods such as interdisciplinary research,this article elaborates on the implementation of community service management standards in the Chinese-style socialist legal system.It discusses how to promote the community service criminal legislation,and refines the community service implementation management in the existing legal system.It proposes to promote the construction of a multiple governance system in the criminal justice field with government procurement.Strive to improve the community service criminal legislation and promote social governance innovation in criminal justice.
