Reformation Of Xinfang Institution

Nowadays,the number of Xinfang exceeds ten million person-time,and to tackle this issue and maintain social stability,the“Great Xinfang”pattern with higher leadership became the preference of authority.However,the raging “Great Xinfang” pattern has not effectively resolved the Xinfang peaks,but instead it has a great impact on the progress of rule of law.In the present Xinfang practice,repeated Xinfang,group Xinfang,Xinfang concerned law or suit and abnormal Xinfang are quite common,so that the reception work becomes rather heavy and consumes a large amount of administrative resources.Through investigation and research,the author finds that the reasons for the Xinfang difficulty include the traditional ideology,orientation of Xinfang system,judicial construction,relief convergence and several other aspects.In addition,the petition statement system in Taiwan,China and the ombudsman system in foreign countries can give enlightenment to the Xinfang reformation in our country and deserve to be imitated by the reformers.The author believes that the future reformation direction should lie in weakening the Xinfang function and stripping Xinfang relief in establishing the judicial authority,so as to enable the Xinfang to go back to its orientation of collecting public opinions.The rights of the citizens should firstly be guaranteed legally through developing various “legalized” relief means.The stripped Xinfang relief function should be added into the system construction of people’s congress,thus laws will endow NPCmembers with investigation power and suggestion right.As a result,people’s deputies will be able to intervene in typical Xinfang cases and outstanding social conflicts.
