The Legal Prevention Mechanism To The Crime Of School Violence In Our Country

Campus violence is a universal campus phenomenon,which is widely spread around the world,and brings great harm to the social development of various countries.International and domestic scholars have carried out detailed research and analysis on campus violence from the perspective of Pathology,Sociology and Management,and obtained important research results.In the past,the research on analyzing the causes of campus violence is mainly from the four aspects of Society,Family,School and Persons.But there are few studies on the causes of campus violence from the perspective of law.At present,the main causes of campus violence in our country are:Firstly,the absence of the law,the rules of campus security scattered in many laws and regulations,such as Education Law and Law of protection Minors,lack of systematicness and operability;Secondly,insufficient publicity for the rule of law,the campus law publicity form is single,families not enough to attract the sense of rule of law,causing students to deal improperly with campus violence or don't know how to deal with it;Thirdly,law enforcement and administration of justic is ineffective,the absence of law enforcement bodies and the forgiveness of the judiciary encourages violence on campus.This paper analyzes the causes of campus violence,and tries to find out some measures and methods of preventing violence from the perspective of law.First,legislative preparedness,to modify the existing law and improve the operability of relevant laws;opportunity to introduce <Campus Security Law>,regulate all aspects of campus security,and play its leading role in campus security.Second,the publicity of legal system.The school and family should actively teach the law,and Students themselves must study hard.Establish legal awareness,when confronted with violence on campus,it is resolved in a timely manner through the law.Third,law enforcement to prevent.Law enforcement departments should make a comprehensive improvement on the social environment around campus,root out the breeding ground of violence.Fourth,the judicial prevention.Judicial organs should increase the punishment of violent cases on campus,Reduce campus violence by means of judicial deterrent effect.
