A Study On Legal System Of Agricultural Ecological Compensation In China

The Third Plenary Session of the 18 th CPC Central Committee proposed vigorously advancing the construction of ecological civilization.In the face of the severe situation of tight resource constraints,severe environmental pollution,and degraded ecosystems,we must give prominence to ecological civilization construction.In 2016,the State Council promulgated the "Opinions on Perfecting Ecological Protection Compensation Mechanism".Ecological compensation has become an important strategic guideline for ecological environmental protection.These documents provide guidance on the development of China's agricultural ecological compensation work,and use this as an opportunity to conduct research on the agricultural ecological compensation legal system,and provide more reference for the construction of legal systems and agricultural ecological protection.In this paper,the concepts of ecological compensation and agricultural ecological compensation are first sorted out,and the theoretical basis of the agricultural ecological compensation legal system is elaborated.The author has collated domestic laws,regulations,rules and regulations,local legislation and policy documents on agricultural ecological compensation,and combed statistical data to sort out the practice of agricultural ecological compensation in China,and summarized the problems in the construction of China's agricultural ecological compensation legal system..The text also analyzes the legal construction of the United States,Europe and Japan in the field of agricultural ecological compensation.The European and American countries and Japan have carried out agricultural ecological compensation earlier.They have advanced legislative ideas and practical experience,which brings inspiration to China's agricultural ecological compensation law construction.Finally,the author proposes suggestions on the construction of China's agricultural ecological compensation law from three aspects,from the legal system construction to the basic legal protection,and finally proposes to implement a national-level agricultural ecological compensation plan with a long-lasting guarantee mechanism to give protection to the legal system.This will not only enable China's agricultural ecological environment to be protected but also achieve the goal of sustainable agricultural development.This article interprets the national policy and attaches great importance to the establishment and implementation of the agricultural ecological compensation legal system.Based on the problems encountered in the agricultural ecologicalcompensation legislation and the inspiration of advanced foreign development experience,this article summarizes the agricultural ecological compensation laws that are suitable for the actual situation in China.The recommendations for a sound system ensure that the agricultural ecological environment is effectively protected under the protection of authoritative legislation,and that the agricultural ecological compensation mechanism can be implemented smoothly and with fruitful results.
