Research On Legal Issues Of Chinese Medical Waste Management

The development of medical and health care and the huge population base,make the output of medical wastes in China is enormous.In recent years,under the drive of illegal interests,medical wastes pollution events frequently occur.In the case of double limit of current economy and the technology,to build and rational medical waste management system is more urgent and critical.The legal construction of medical waste management in China started late.In 2003,the state council promulgated the "regulations on the management of medical waste" and subsequently issued a series of specific laws and regulations,which officially opened up the new situation of the legal process of medical waste management in China.Reality practice shows that,although in medical waste management in China has obtained the certain result,medical waste management in China still has a lot of even tough new problems.There is still a long way to make medical waste disposal reduction,recycling and harmless.The reason is mainly caused by that the system construction is not perfect.It is urgent to continue to promote the legal construction of medical waste management in China.This article with the study of the legal problem of medical waste management laws in China as the core.The first to introduce the status of medical waste management law regulation and point out medical waste management legal system construction in our country remains to be perfect to highlight the necessity of strengthening the medical waste management.Then,the author introduces some experiences of medical waste management legislation in some foreign countries.Then turn back to in-depth analysis the legal problems of the medical waste management in our country,in the perspective of the law in that deep analysis basic process,supervision mechanism and treatment of medical waste disposal expenses related problems,to seek the direction of medical waste management in our country legal system construction development.Finally,guided by the principle of "the three",and based on national conditions and moderate draw lessons from foreign experience in relevant legal countermeasures,there are new opinions including the mechanism for ensuring adequate funding for the adjustment of the system of centralized treatment and disposal construction in this paper,the author,in order to be helpful to the legal construction of medical waste management in China.
