Legal Issues On Regulation Over The Medical Waste

According to reports of the 19 th National Congress of the Communist Party of China,We should strengthen the construction of ecological civilization and promote green development,strive to solve environmental problems,strengthen the protection of ecological system and reform the supervision system of ecological environment.Among them,"strengthening solid waste and refuse disposal" was emphasized.The prevention and control of medical waste pollution is an important part of urban public health management and ecological environment construction.China issued the Regulations on the Administration of Medical Waste in 2003,followed by a series of supporting regulations,the management of medical waste has achieved some results,However,there is still the phenomenon of resale and illegal disposal of medical waste,which is fundamental,and poor supervision is the main reason.On the basis of the existing system,improve the medical waste management system,strengthen the inspection and supervision of all aspects of medical waste,thoroughly "cut off" the chain of interests behind the sale of medical waste,to achieve the full supervision of medical waste.The recyclable part will be recycled,to achieve the reduction of solid waste,in order to make the "no waste city" construction a step forward,to achieve environmental-friendly urban construction,so that the people can use peace of mind,eat at ease.In fact,the need to use ultra-high technology disposal of medical waste only a few,there are more infusion tubes and infusion bottles and other plastic products,this kind of medical waste material has special,it is made into plastic raw materials profit is high,coupled with a large number,need to attract enough attention to this part of the medical waste attention.Based on China’s medical waste management system as a starting point,this paper pays attention to the shortcomings in various systems,combs the supervision responsibilities of medical waste-related units and government departments,and puts forward suggestions to improve the medical waste management system in China and strengthen supervision and inspection.There are five parts for the thesis: the first part explains the seriousness of the medical waste regulatory problem,and introduces the current situation of domestic and foreign research;The second part introduces the relevant content of medical waste,clarifies the scope of various types of medical waste;The third part,introduces the current norms of domestic medical waste,medical waste related management system;The fourth part,from the medical waste collection,transportation,disposal,recycling and charging,etc.put forward the deficiencies of the management system,the relevant units supervision work is not in place,etc.put forward the problems of Medical waste supervision in China;In order to improve China’s medical waste supervision to provide reference;The sixth part,combined with China’s national conditions,according to local conditions,from the improvement of medical waste management system,strengthen inspection and supervision and other aspects of the solution,improve China’s medical waste legal supervision.This paper innovatively puts forward from the medical and health institutions,the internal supervision of disposal units and the external supervision of the government administrative departments,to make up the loopholes in China’s medical waste supervision and inspection.By expanding the scope of medical waste,listing the general waste category,pointing out the existing medical waste supervision system in China,and exploring effective regulatory countermeasures.
