Research On New Type Of Duty Crimes In Universities

Duty crime and its prevention are the eternal topics in the world.Since the eighteen major,the anti-corruption efforts of the Party Central Committee,with Comrade Xi Jinping as the core,have been increasing,and the struggle against corruption has taken on an overwhelming trend.The problems in the field of duty crime show a lot of high incidence,colleges and universities as "ivory tower" and "pure land of one side" are no exception.Due to the lack of awareness of the rule of law in some colleges and universities,the relative lag of the management system,the unreasonable distribution of power and the inadequate internal supervision mechanism,the problems of corruption in the departments of infrastructure construction,enrollment,logistics and scientific research fund management are prominent,and the incidence rate is rising year by year and the location of the case is relatively concentrated.The number of cases is increasing,and the level of educational staff is higher and higher.The problem of job crime in colleges and universities has seriously damaged the image of universities.It has been widely criticized and questioned by the public,and it has also aroused the attention of scholars.Based on combing the general characteristics of the basic connotation of the duty crime in colleges and universities,this paper,from the angle of jurisprudence,compares the four elements of the constitution of the crime,and sums up the characteristics of the new type of duty crime in colleges and universities from the aspects of the time of the case,the field of the case,the way of the case and so on.Three typical cases are carefully selected from the new job offenders in colleges and universities,namely,the former vice principal of Zhejiang University,known by the public as the largest corruption case in Chinese colleges and universities;the corruption cases which have extensive influences in academic circles: the youngest Chinese academician Lining in the former Chinese Academy of Sciences,and the enrolment of a special college student in Jiangsu university.By using literatureresearch,case analysis,comparative analysis and other methods,we report the incident,analyze the focus of dispute and analyze the cause of the incident.In the end,the article clarifies the harmfulness of the duty offenders in colleges and universities from three aspects,which violating the purpose of educating people in colleges and universities,impairing the image and prestige of colleges and universities,and influencing the internal stability and development order of colleges and universities.The main ways to prevent the duty crime of colleges and universities are put forward from four aspects,which are to improve the cultural and educational system of colleges and universities,to configure the operating mechanism of scientific power in Colleges and universities,to improve the management system of scientific research funds in Colleges and universities and to strengthen the law of power supervision in Colleges and universities.This study attempts to further improve the prevention mechanism of job-related crimes in the abstract and provide a practical implementation plan in practice.
