The continuous development of Internet technology and mobile intelligent terminals has promoted the prosperity of sharing economy,and the online car-hailing of the representative industry of sharing economy has gradually entered the public's vision.Relying on the advantages of the Internet,online car-hailing has gradually realized accurate matching service of supply and demand,which not only revitalizes idle social resources,but also improves the efficiency of road resources utilization and provides high-quality travel services for the public.Although the social and economic benefits of online ride-hailing are significant,it still brings many problems,such as disrupting the order of market competition,conflicts with the traditional taxi industry,frequent safety problems and information security risks,which all pose challenges to the effective regulation of online car-hailing by the government.On the surface,the problem of ride-hailing is a contradiction caused by the inability of market demand to be effectively balanced,but on a deeper level,it reflects the conflict between the idea of government governance in the context of sharing economy and the traditional way of government supervision.As the problem of online car-hailing becomes more and more serious,the government and other relevant departments have taken corresponding measures.In July 2016,the interim measures on the management of online taxi booking business services was officially issued,which marked that China recognized the legal status of online taxi booking from the central level,and the government regulation on online taxi booking entered the implementation stage with laws to follow.Since October 2016,major cities across the country have issued local regulations on the administration of online ride-hailing,and the promulgation of these regulations actually represents the vane regulated by China's online car-hailing government.Despite the implementation of the new policy,the regulation method of online ride-hailing is not satisfactory,which is mainly reflected in the following aspects: first,the concept of regulation lags behind.The central government has delegated the specific regulation power of online ride-hailing to local governments.However,from the perspective of the regulations on local online car-hailing management,the contents of the regulations only reflect passive control.The government hopes to solve the existing problems in a short period of time and lacks the initiative guidance and innovation consciousness,which makes it difficult to effectively promote the integration and development of the two business forms.Second,regulate path dependence.Central level requirements of the principle of "high quality service,differential operation" is the understanding of the local governments hard to high configuration,high price,because of the lack of local government about car regulation experience,and there is no formal laws and regulations,so the traditional taxi industry management experience on the net car regulation problem of the ark and sank into the regulation method of path dependence,mainly reflected in the network about the car driver and vehicle access Settings.Based on this,on the basis of drawing lessons from foreign regulations on online car-hailing,this paper believes that the government should regulate online car-hailing from four aspects: first,adjust the content of regulations on online car-hailing.From the perspective of the regulations on the management of online car-hailing issued by local governments,the regulations on the access of online car-hailing drivers and vehicles are too strict and lack the supervision of online car-hailing platform enterprises.Therefore,it is necessary to adjust the contents of online car-hailing government regulations to better adapt to the development of online car-hailing industry.Second,improve relevant legislation on online car-hailing.The lack of legislation is one of the important reasons for the difficult regulation of the government.The rapid development of online ride-hailing industry,lagging behind relevant laws and regulations,and a long period of law making,make the formation of the basis of online car-hailing regulation and the speed of online car-hailing development do not match.Third,update the concept of online car-hailing regulation.The regulation of online ride-hailing cannot be separated from the general background of sharing economy.Online car-hailing is not the internet-based development of traditional taxis,let alone the simple addition of the Internet and taxis.Government regulation of online car-hailing should be based on the concept of sharing economy to avoid falling into the dependence of traditional regulation paths.Fourth,innovate the regulation path of online car-hailing.Internet ride-hailing itself is a new thing,and the regulation of it cannot follow the traditional old way,we should break the fixed thinking mode,according to the characteristics of Internet car-hailing,to find a suitable regulatory path.
