Research On Digital Music Copyright Licensing Model

The licensing model plays an important role in copyright transactions and is the core of maximizing the value of works.A reasonable licensing model can effectively reduce transaction costs and maximize the value of works.On the other hand,if the transaction costs are too high,the value of the work will be lost in the process of dissemination and cause market failure.Since 2015,the government has intensified the rectification of the digital music industry,cracked down on piracy,strengthened mutual licensing,and promoted the emergence of large-scale music works.The copyright market has experienced unprecedented phenomenon,but the existing licensing model in China is impacted by digital technology.The following can not meet the needs of all parties,which cause the imbalance between the interests of the copyright parties,digital music service providers and users,the phenomenon of "failure" in the copyright trading market.Based on these difficulties,innovative licensing models are needed to meet the needs of industry players and to balance their differences of interests,thereby promoting the orderly development of the music industry.Therefore,by studying the existing theories and starting from the practice of China's digital music copyright licensing model,this paper explores the inherent crux of the existing copyright licensing model of music in order to find new ideas for the construction of a licensing model to solve the current difficulties and maximize the value of music works in the digital environment.The main body of this article contains the following five parts:The first part takes the rectification regulations promulgated by the State Administration of Copyright and SARFT as an opportunity,which leads to the current active market for digital music licensing transactions in China and the urgent need to improve the background of digital music copyright licensing.At the same time,it introduces the research significance of this paper,combs the current research status at home and abroad,and explains the research ideas and methods used in this paper.The second part clarifies the concept and classification of digital music copyright licensing model and analyzes the applicable conditions and respective advantages of digital music copyright licensing model respectively.It provides a reasonable theoretical basis for the improvement of China's digital music copyright licensing model.The third part starts from the legislative status and implementation status of China's existing copyright licensing model and analyzes the predicament of China's copyright licensing model in the digital environment in order to find the crux of the problem that plagues China's digital music licensing model.The fourth part,from the perspective of comparative research,conducts an empirical investigation of the country's music copyright licensing model in order to seek some new inspirations for the construction of China's digital music copyright licensing model by drawing lessons from the legislation experience and the reform path of the copyright licensing model for digital music in Europe and the United States.In the fifth part,on the basis of summarizing the copyright licensing model of foreign digital music,the author proposes the reconstruction and new construction proposal of the copyright licensing model of digital music in China.First of all,through the improvement of the statutory licensing system and the reshaping of the collective management organization in China,the coordination of the dissemination efficiency and licensing efficiency of music works is achieved.Secondly,aiming at the outstanding problem of "long-tailed phenomenon" under the digital environment,the proposal of establishing a one-stop online licensing platform is proposed.Through the window of direct dialogue between the two parties,one-stop service is provided to protect the rights holder's different value needs.
