Research On The Copyright License Model Of Digital Music Works

The mass popularization of the Internet has greatly changed the information dissemination channels and storage methods of traditional music creations in our country,and gave birth to the emergence of digital music creations in our country.This may be another major revolution in various fields of the art world.However,the development and application of new technologies make the copyright protection of digital music works face new difficulties.Changes in the media of digital music have led to changes in users’ consumption patterns,which greatly challenge the existing music copyright licensing system.With the application and promotion of exclusive licenses and centralized licenses in my country frustrated,it is urgent to find an effective licensing model to cope with the changes brought about by the Internet to the music world.Based on the background of the development of digital music works,this article analyzes the pros and cons of the current digital music copyright exclusive licensing model,the pros and cons of the centralized licensing model,and the pros and cons of the legal licensing model,and believes that the legal licensing model is more in line with the current overall development of copyright.Then the author demonstrated the necessity of the legal permission model from the perspectives of jurisprudence,balance of interests,and economics.Therefore,the statutory licensing system still has its inherent necessity and feasibility in supplementing the construction of a reasonable transaction model between music copyright owners and network service providers.Finally,based on the protection status of digital music works in my country,the author proposes to delete the provisions of the "Provisions";increase the relevant provisions of the "rights retention period";expand the scope of rights of producers of secondary sound recordings;clarify the prerequisites for the legal licensing of sound recordings.Suggestions on improving the relevant procedural design and improving the operability of the statutory licensing system will escort the healthy development of the copyright licensing model of digital music works in my country.
