Since the advent of shared bicycles in China,there have been a lot of news reports about the pros and cons of the controversy,and the way people travel in life has changed dramatically because of these colorful bicycles.A shared bicycle is a kind of bicycle with Internet control function that is rented to the general public by the enterprise.The public pays the enterprise through the mobile phone and collects the vehicle and returns it to the nearest place.However,in the event of personal injuries,bicycle damage,difficulty in returning deposits,indiscriminate suspension,user information disclosure and financing bubble problems,our country is still left blank on this issue.To legally regulate emerging issues,we must understand the reasons behind its rise.Under the background of the Internet,the development of the sharing economy came into being.It facilitates people's travel and gradually changes our lives.The specific institutional construction needs to be based on existing foreign theoretical results.The United States,Germany,France,and Japan have more extensive institutional experience and a longer course of bicycle development.In the case of legal blind spots,the fact that many cases of sharing bicycles in our country are not handled rigorously has affected judges' determination of cases.In order to solve various problems that arise in reality,it is necessary to conduct in-depth theoretical research so that there can be laws and regulations in concrete practice.We can draw lessons from the "empty network" of the entire process from legislative blank to law-abiding,learn useful experience,and develop economic models in the same context as the Internet.Specifically,a clear orientation should be given to shared bicycles.There is a huge disagreement among academics about whether their attributes belong to a shared economy.This article argues that shared bicycles are a type of shared economy.After that,it analyzes the impact of the lack of legal regulation and the subsequent impact,and clarifies the necessity of legal regulation,including the imperfect supervision system,the unclear subject of the liability,and the lack of strictness of the qualification review.Finally,it gives its own opinion.After drawing lessons from the relevant legislation of the “about network car” and the experience of sharing bicycles abroad,it puts forward its own opinions on the legal regulation of sharing bicycles in China.Accelerate the construction of legislation,improve judicial remedies,administrative relief,social relief,etc.,so as to achieve the goal of having laws.
