The suspension of the Doha negotiations has led to a period of stagnation in multilateral trade cooperation,and the regional economic cooperation has become a new direction for the world to seek economic development.With the continuous enhancement of comprehensive national strength and the expansion of opening-up to the outside world,China has also been actively engaged in the Asia-Pacific Economic cooperation.However,there is a large number of economic cooperation frameworks exist in the Asia-Pacific region,such as ?Regional Comprehensive Economic Partnership Agreement ?(RCEP),which China has actively promoted,the ?Comprehensive and Progressive Trans-Pacific Partnership?(CPTPP),which is currently the highest standard in the world,and Free Trade Area of the Asia-Pacific(FTAAP).Faced with such a complicated situation,this thesis mainly explores how China should choose and how to speed up the negotiation process in participating in the Asia-Pacific Regional Free Trade Agreement from the legal aspect.This thesis consists of four chapters:The first chapter is an introduction,which is divided into four sections: the first section introduces the background and significance of the selected topic;the second section sorts out the relevant research at home and abroad;the third section introduces the research scheme of this paper,namely the writing train of thought and research method of this paper;and the fourth section gives a brief explanation of the possible innovation points of this thesis.The second chapter is the status of the establishment of the Asia-Pacific regional Free Trade Agreement,which is divided into four sections: sections I,II and III,respectively introduce the background,main development processes and recent developments proposed by the ?Regional Comprehensive Economic Partnership Agreement ?(RCEP),the ? Comprehensive and Progressive Trans-Pacific Partnership Agreement?(CPTPP)and Free Trade Area of the Asia-Pacific(FTAAP);and the fourth section compares three parallel but different mechanisms to derive the advantages and disadvantages of each mechanism in the current development process.The third chapter is the choice of China's participation in the Asia-Pacific Free Trade Agreement,which is divided into four sections: the first section shows that China's participation in the Asia-Pacific free trade pilot area not only conforms to the trend of globalization and regional integration in the world,but also conforms to China's national interests of opening up to the outside world;the second section proposes that RCEP will be an upgraded version of the WTO which is more suitable for the developing countries;the third section proposes that CPTPP,although it freezes the effectiveness of some provisions,it is still the highest quality agreement in the world,so China should actively study its terms and not give up the possibility of accession in the nearly future;the fourth section puts forward that it is very important to build FTAAP as soon as possible,which under the background of the China-USA trade frictions.The fourth chapter is China's negotiating response to the Asia-Pacific free trade agreement,which is divided into three sections: the first section from China's domestic establishment of the Free Trade Zone system,proposed that the Free Trade Zone should continue to improve the legal system,such as the harmonization of negative list system and the formulation of relevant laws at the national level as soon as possible;the second section proposed that China should continue to promote the negotiation process of RCEP at first,study the traditional issues under the WTO framework,and study the issue of environmental protection,labor stability which are not covered in the original WTO framework.The third section proposes that the establishment of FTAAP will create a good and stable trading environment and promote the positive prosperity of various countries.Therefore,it is necessary to maintain the focus on the establishment of FTAAP and keep moving forward.
