| The Fourth Plenary Session of the 18th Central Committee of the Communist Party of China proposed to promote the rule of law at the grass-roots level.The rural governance is at the foundation of the national governance system,carrying the important task of promoting rural civilization and simplicity,harmonious and orderly society,flourishing industry,and people living in affluence and so on.Promoting the rule of law in rural governance is of great significance to realize the modernization of state governance system and governance capability,to comprehensively promote the rule of law,to better implement the Strategy of Rural Revitalization.Therefore,in the new era,we should form a legalized governance system based on governance norms,governance subject,governance process,mutual connection and interaction of governance environment,to promote the legalization of rural governance.This paper will focus on the theme of legalization of rural governance,and discuss according to the logic of"What is the legalization of rural governance","Why we should carry out the legalization of rural governance" and "How to realize the legalization of rural governance".On the basis of clarifying the scientific connotation of rural governance by law in the new era,focusing on "Why",this paper analyzes the theoretical and practical values of the legalization of rural governance in the new era;Focusing on "How",the paper analyzes the practical problems existing in the legalization of rural governance in the new era,and explores the scientific path to solve the plight of the legalization of rural governance.The first chapter explains the theory of rule of law in rural governance in the new era.Specifically,it includes:defining the concepts of rural governance,the rule of law of rural governance and the rule of law of rural governance in the new era,analyzing the basic principles of the rule of law of rural governance in the new era,and analyzing the theoretical basis of the rule of law of rural governance in the new era from Xi Jinping’s thought of rural governance in the new era and the theory of good law and good governance of socialism with Chinese characteristics.The second chapter is devoted to analyzing the value implication of promoting the rule of law in rural governance in the new era.In terms of theoretical value,the legalization of rural governance in the new era is the inheritance and development of the"rule of courtesy"in the traditional society,the "rule of law" in the modern society and the "rule of law" in the countryside after the reform and opening-up;In terms of practical value,it is of great significance to realize the modernization of state governance,promote the overall rule of law,promote the development of rural society and safeguard the rights and interests of grassroots people.The third chapter is based on the reality,discussing the current situation and practical dilemma of the rule of law in rural governance.Mainly select Malinggang Town of Heze City as the research object,through case study to analyze the practice of rule of law in rural governance,it is found that rural governance laws and regulations tend to be perfect,the main body of pluralistic governance is basically formed,and the villagers’ legal consciousness is gradually enhanced;at the same time,there are some problems,such as poor convergence of governance norms,unclear power and responsibility of governance doctrine,irregular operation of governance process,and so on.Administer the realistic predicament such as insufficient environmental protection.The fourth chapter mainly analyzes the experience of the rule of law in rural governance abroad.Japan,the United States,South Korea and other representative countries are selected to sort out and sum up their experiences in the legalization of rural governance,and draw lessons for reference:perfect laws and regulations system is the basic basis;clear governance subject power and responsibility is the key link;developed social organization participation is the necessary content;mature citizen legal consciousness is the fundamental requirement.On the basis of chapter three and four,the fifth chapter discusses the basic ways to realize the rule of law in rural governance in the new era.Improve the system of governance norms,through the revision of laws and regulations and folk norms,to promote the rule of law;Clarify the power and responsibility of the main body of governance,to improve the leadership of the Party,to strengthen democracy at the grass-roots level,to develop non-governmental organizations,to attract the rural elite,and to promote the rule of law of the main body of governance through the transformation of government functions;Construct scientific system mechanism,through establishing and perfecting interactive consultation mechanism,supervision and evaluation mechanism,dispute resolution mechanism,promote the governance process of rule by law;Cultivate rural culture of ruling by law,to cultivate the thinking of governing subject by law,to cultivate the consciousness of ruling by law of ordinary villagers,to mold the rural public spirit,to optimize the supply of rule of law culture,and to promote the legalization of governance environment. |
