The Difficulties And Breakthroughs In The Investigation Of Bribery Cases In Village Committee Elections

Since the implementation of the village committee election system in China,there has been great progress in the awareness of the democracy,rule of law,and politics.Moreover,rural villagers' consciousness in political participation has effectively promoted the construction pace of grassroots' democracy in China,strengthening unity,stabilizing society,and developing economy.As one of the important carriers of democracy at the grassroots' level in China,the election of village committees is inevitably controversial in some aspects after more than 20 years of development.Among the controversies,bribery is a more compelling and urgent problem.In recent years,with the continuous deepening of China's democratic politics,the electoral competition has been continuously enhanced,and the level of economic development has been continuously improved.The phenomenon of bribery in the election of village committees has also appeared and presented a trend of proliferation.Bribery has been in jeopardy to the development of villagers' autonomy and has become a cancer that hinders the healthy development of rural grassroots' democratic institutions.It not only erodes the body of China's autonomy system,but also jeopardizes the healthy development of socialist consultation democracy.Therefore,in order to develop the long-term healthy development of democracy at the grassroots' level,we must pay enough attention to the investigation and punish bribery.Nowadays China is promoting the rule of law in all aspects,it is of great necessity to investigate and punish bribery in the election of village committees on the basis of facts and the law should be made the criterion.But unfortunately,problems appear due to the existing "Village Committee Organization Law" and other relevant laws in the regulation of the electoral order,coupled with the complexity of the bribery itself,and difficulties in the investigation and handling of bribery cases in the village committee elections.The unfavorable investigation and handling of bribery elections in the village committee elections have also led to the spread of bribery and brought great impact to the development of democracy at the grassroots' level.In order to effectively control the chaos of bribery elections in village committee elections,it is necessary to strengthen the investigation and handling of bribery elections.On the basis of the analysis of existing data,combined with the current situation of theinvestigation and handling of bribery cases in the current village committee elections,this paper lists the four major dilemmas in the investigation of bribery cases: 1)the subject's powers and responsibilities are unclear;2)it is difficult to find bribery and investigate and collect corresponding evidence;3)It is difficult to determine bribery behavior and cope with of the bribery actor;and 4)it is hard to analyzes the reasons for the problems in the investigation of bribery cases.To solve the aforementioned dilemmas as to the investigation of bribery elections in village committee elections,it is necessary to clarify the investigation subject,improve the investigation system,change methods of the investigation and evidence collection methods,and improve the ability to collect evidence.It is strongly advisable to strengthen the election legislation and clarify the criteria for determining bribery and improve the disciplinary measures for bribery in the hope of clearing the obstacles in the investigation of bribery cases.
