The Research On The Legal Regulation Of Non-profit Organizations Participating In Government Purchasing Public Service

With the rapid development of China's economic level,the masses' demand for social interests is becoming more and more diversified,the original interest pattern has changed significantly,and the needs of citizens' public service are becoming more and more individualized and diversified,which has formed a distinct challenge to the traditional public service policy system,financial security,supply mechanism and so on.The government's purchase of public services from non-governmental organizations as a new concept,new mechanism and trend of "administrative function reform" is not the same as the traditional supply model of the government's own direct supply of public services to citizens.In the existing practice,the purchase of public services by the Government is conducive to the transformation of government functions,can save financial funds to a large extent,and can improve the quality of public services,in the market competition unique attributes,"Administrative failure" phenomenon has been better alleviated.Because the government buys public service has the public welfare attribute,the public product theory decides should adhere to the public welfare purpose,optimizes the market allocation,the moderate management intervention,and from the market access control,the price profit control,the public interest guarantee and so on specific system,refines and perfects.Starting with the relevant concepts,this paper begins with the public interest,providing efficient and high quality public services,combined with the economic definition of public services,and points out the irreplaceable importance of non-profit organizations participating in government purchase of public services and their status quo.The second part,through the analysis of Anglo-American and other countries management experience of non-profit organizations,especially the regulation of non-profit organizations in involving the Government to purchase public services,through empirical analysis,to obtain a more feasible and appropriate direction of development and disposal methods.The third part introduces the laws and regulations on the participation of non-profit organizations in public service at present,and puts forward some areas for improvement in the legal regulation of legislation.The Part ?,in view of the substantive problems existing in theory and practice,finds the improvement direction of the shortcomings of the existing system by analyzing the existing problems,combining with the specific problems of each link in practice,including the financial situation and management,combining the obstacles and general rules of organizational development,and the actual tax collection situation.Combining with the existing foreign experience,this paper puts forward reasonable suggestions to perfect and guarantee the non-profit organization to serve the public.
