| The rapid economic development has promoted the level of urbanization and the growth of the entire urban population.With the rapid development of the aged population in cities and towns,how to solve the problem of providing for the aged population in cities and towns is related to the development process of urbanization in China and affects the stability of the whole society in China.It is a hot issue in today's society to solve the old people's life in their later years.It has already become an important topic in important conferences such as the National People's Congress and the National People's Congress.It can be seen that it is urgent for us to solve the old-age problem.If the old people's pension situation can be guaranteed,it will not only enable the old people to spend their twilight years peacefully and promote the healthy and harmonious development of China's social welfare undertakings,but also enable the young people not only to settle their maintenance obligations,but also to devote themselves to their socialist modernization construction with no worries,which can be said to achieve three goals at one stroke.In this paper,I will analyze and study the current situation of the home-based care model and various legal theories related to it,and then try to find out the legal problems existing in it by combining the collation of a large number of data and the comprehensive analysis of relevant documents,and put forward my own countermeasures and improvement suggestions to these problems accordingly.Finally,we can draw the following conclusion: at present,we can start from relevant laws,regulations and policies,make full use of social resources,and mobilize all available factors to develop the cause of providing for the aged.As a social security system,the settlement of the pension problem is conducive to maintaining social harmony and stability and promoting the healthy and orderly development of the socialist pension system with Chinese characteristics.The full text consists of four chapters: Firstly,the theme of the article is drawn from the research background,the research status at home and abroad,the research ideas and the research significance.The first chapter is followed by an overview of the concept of home care.The second chapter introduces the legal basis and significance of the home care system.In the third chapter,taking Lanzhou virtual nursing home as an example,I made an in-depth analysis of its development and made an in-depth analysis of the problems arising from the development of home-based care from the perspectives of legislation,law enforcement,justice and legal supervision from the perspective of the rule of law.The fourth chapter is to putforward relevant legal research countermeasures for the problems in the previous chapter,trying to provide their own reference opinions for the better and faster development of home care.The last part is a general summary of the whole article. |
