Research On Legal System Of Traceability Of Food Quality And Security

Food security is an overall major strategic issue concerning China's national economic development and social stability.Food quality and security is a higher level of food security requirements,involving the people's health and life security,is a basic livelihood issues.In the opinions on accelerating the supply-side structural reform of agriculture and vigorously developing the food industry and economy,issued by the state council in 2017,the establishment of a food quality safety traceability system and platform and the improvement of regulatory linkage mechanism were stipulated.The establishment and improvement of food quality safety traceability system can strengthen the supervision and management of food quality by the state,guarantee the right to know of consumers,and strengthen the self-discipline of food enterprises.At present,only food safety law clearly proposes the establishment of food quality safety traceability system,but only in principle.The food quality and safety traceability system is only mentioned in the documents issued by the state council and has not been clearly stipulated in the law.In addition,China currently lacks a unified traceability code,traceability standards and traceability information platform.In practice,these problems lead to the incomplete implementation of the traceability system.As for the above problems,it takes the current situation of China's food quality safety traceability legal system as the foundation,practice as the problem orientation,adopts literature research method,comparative research method to analyze the problems existing in the operation of this system.In this process,some developed countries such as the European Union,the United States and Japan are analyzed and used for reference to their mature experience in the traceability system.Combined with China's specific national conditions,Suggestions are put forward to improve China's relevant legal system.In order to ensure food quality and safety;safeguard the legitimate rights interests of consumers,it is necessary to improve the legal provisions of the food quality and safety traceability system,regulate the responsibilities of the government in the traceability system,improve thetraceability measures and optimize the forms of legal responsibilities.
