The Research On Improving The Legislation Of Our Family Support System

By the end of 2017,the population of over 60 years old has exceeded 240 million in China,accounting for 17.33% of the population.Aged tendency of population is a serious problem that China is facing now and in the coming decades.In reality,there are still numerous reports that old people need to support themselves,lonely and tough.To deal with this problem,we not only need to rely on family support,but also need the government to assume the corresponding responsibility and a sound social security system.However,China's national conditions are: the support of the elderly is still the main mode of home-based care,the social security system is not sound.Therefore,family support is the mainstream way of supporting the elderly in China,and family support to meet the spiritual needs of the elderly is the elderly security system cannot be replaced.,Therefore,improving the family support system is of great significance to China,which is seriously aging.Filial piety is the traditional virtue of our Chinese nation,and it is the legal obligation.China's support system is not complete,the legal norms are chaotic,the legal language is not accurate,rigorous,most of the legal norms lack probability;The legislation of the support system is not forward-looking enough,which leads to the law enacted cannot meet the growing changes of the society,and the gap between law and society appears.Support rights are often not promptly and effectively protected.In addition,it is worth exploring how to protect the intangible rights and of spiritual support with legislation.Based on the legal characteristics of the support system and the status quo of the maintenance legislation in China,this paper analyzes the problems of the maintenance system in China based on the actual cases and situations,and puts forward corresponding Suggestions for improvement.From the current situation of China's maintenance problems,based on the analysis of the defects in the legislation of our country's support system,corresponding Suggestions will be put forward to improve the legislation of our country's support system.
