| On family support is an important part of China’s old-age security system,improve the function of family support,family support legislation system is our country to deal with the aging of the necessary measures,but the family support system principle legislation,support obligation to execute the way such problems as incomplete fuzzy and related content gradually exposed,family pension crisis support frequent disputes,Therefore,it is necessary to optimize the legislative system of family support responsibility.The first chapter of this paper introduces the basic content of the support system,from the concept of support and related concepts and the difference between the introduction,and then to the characteristics of the support system and the practical significance of the support system,clear the object of this paper.The second chapter starts with two main concepts of old-age security:social security and child support.This paper discusses the relationship between society and family in the old-age support system,then introduces the historical evolution and legislative situation of the domestic and foreign support system,and concludes that we should insist on the base of family support while improving the social support.The third chapter mainly combines the supporting disputes in judicial practice and the practical difficulties faced by the elderly in aging our years.It systematically expounds the deficiencies of the legislation of the maintenance system from the aspects of the lack of principled legislation,the unknown occurrence of the rights and obligations of the maintenance,the vague provisions of the content,and the failure to provide the defense reasons of the maintenance obligor.The last chapter is based on the previous article,the legislative system of foreign countries and reference to the theory of domestic and foreign theory of the maintenace system of perfect way,so as to maximize the function of the family support,to realize old support,old dependence. |
