The Rule Of Law Guarantee For The Role Of The Government In The Rural Revitalization Strategy

President Xi Jinping stressed during the eighth collective study of the 19th Political Bureau of the Central Committee,the implementation of the strategy of rural revitalization is the general strategy for doing a good job in agriculture,rural areas and farmers in the new era,it fully reflects the great importance attached by the Party and the government to the problems of agriculture,rural areas and farmers.Therefore,how governments at all levels play a role in accordance with the general requirements of ecological livable,prosperous industry,effective governance,rich life and civilized local style,to promote the revitalization of the countryside in an orderly and effective manner in accordance with the law,it has become a problem to be faced in both theory and practice.First,according to President Xi Jinping's speech during the eighth collective study of the ninth Politburo of the 19 session:"To give full play to the positive role of the Government in planning guidance,policy support,market supervision,legal security,etc."and the relevant provisions of the Strategic Plan for rural revitalization(2018-2022),The role of government in the strategy of rural revitalization is divided into five major roles,such as planning guidance,financial support for agriculture,education and training,organizational security and social order management.Then,based on the Constitution and the Organic Law of the People's Congress and local people's governments at all levels of the PRC,this paper analyzes and explains the legal basis for the government's five major roles from the perspective of the fundamental law and the constitutional law.Secondly,this paper systematically analyzes the normative basis of the rule of law guarantee played by the government in the strategy of rural revitalization from the aspects of the policy basis,legal basis,rule basis,judicial guarantee document and so on.Thirdly,taking Zhaotong City as a concrete case,this paper discusses its role in rural revitalization strategy,such as planning guidance,financial support for agriculture,education and training,organizational security,social order management and so on,as well as its dilemma of ensuring the rule of law.It is concluded that the revitalization of the countryside should persist in doing its best,act within its means,should not go beyond the stage of development,cannot be separated from the actual goal,and should not engage in formalism and "image engineering".Finally,on the basis of this analysis,this paper puts forward some suggestions to improve the role of the government in ensuring the rule of law.In the process of promoting rural revitalization,there is a lot of theoretical discussion about rural revitalization,but rural revitalization is still difficult in concrete practice.The purpose of this paper is to study how to effectively ensure the five functions of the government in the strategy of rural revitalization by means of law popularization,legislation,law enforcement and justice.History and practice have proved that rural revitalization cannot effectively realize the six objectives of industry,talent.culture,ecology and organizational revitalization by relying solely on rural and peasant autonomy.History and practice have proved that rural revitalization cannot effectively realize the six objectives of industry,talent,culture,ecology and organizational revitalization by relying only on rural and peasant autonomy,and it is also necessary to give full play to the five major roles of the government.However,the play of the five functions must rely on the targeted and operable guarantee of the rule of law,and in accordance with the general requirements of the rural revitalization strategy,shape the effective connection and coordination of autonomy and the rule of law to implement a long-term mechanism for the implementation of the rural revitalization strategy.Finally,promote the modernization of rural governance ability and level.
