Research On The Legal Rights And Interests Of City Ethnic Minority Floating Populations And Its Countermeasures

The protection of the legitimate rights and interests of the floating population of urban ethnic minorities is related to the political stability of the country,national equality and unity,the development of urban ethnic work,and so on,which needs to be paid attention to.In the past 40 years of reform and opening up,the protection of the rights and interests of the floating population of urban ethnic minorities in China has achieved certain results,such as the right to political participation,the right to equality in employment,the right to development,and so on.In recent years,with the rapid increase in the number of urban minority floating population,it not only brings opportunities to the protection of the rights and interests of ethnic minority floating population,but also faces certain challenges,such as the right to vote and to be elected,the right to employment,the right to education and social security are still not fully protected.Taking Guangzhou as an example,this article studies the problems and countermeasures to protect the legitimate rights and interests of the urban minority floating population,which is not only conducive to further safeguarding the rights and interests of ethnic minorities,curbing discrimination and harming the occurrence of words and deeds of ethnic minority people.Promoting the smooth integration of ethnic minority populations into urban life is also a necessary response to the report of the 19 th National Congress of the Communist Party of China,which "protects the rights and interests of the people,stimulates peopleundefineds creativity,and ensures that the people are masters of their own affairs with a system." Under the guidance of Marxist theory,this article takes "the protection of the legitimate rights and interests of the floating population of urban ethnic minorities" as the direct object,and makes comprehensive use of the knowledge of ethnology,political science,sociology,psychology and other disciplines to clarify the concepts and characteristics.On the basis of relevant experience in the domestic and overseas,this article investigates the present situation,problems,influencing factors and countermeasures of 110 minority floating populations in Guangzhou by means of questionnaire survey and in-depth interview.Through the investigation,the author finds that the main cultural level of safeguarding the rights and interests of the floating population of urban ethnic minorities is not high as a whole,the behavior choice of rights and interests protection presents a diversified trend,and the demand for rights and interests protection is diversified and has national characteristics.According to the present situation,the author finds that the legitimaterights and interests of the floating population of urban ethnic minorities still exist the right to vote and to be elected,the right to equality in employment,the right to culture and education,the right to custom,the right to religious belief,the right to enjoy social welfare and social insurance can not be fully protected,which is related to the imperfect system of laws and regulations for the protection of rights and interests,the relatively imperfect working mechanism for the protection of rights and interests,and the lack of understanding of the rights and interests policy by the minority floating population.The main bodyundefineds awareness of safeguarding rights and interests needs to be strengthened and the lack of adaptability of the minority floating population is closely related.It is necessary to strengthen the work of safeguarding the legitimate rights and interests of urban ethnic minorities by perfecting the legal and regulatory system for the protection of the rights and interests of ethnic minorities.It should be solved by establishing and perfecting the mechanism of linking up and down the work of urban ethnic minorities,strengthening the propaganda and education to safeguard the legitimate rights and interests of ethnic minorities,and striving to improve the ability of the floating population of urban ethnic minorities.
