Local Legislation Research For Protecting The Rights And Interests Of Tourists In Sanya City

With the rapid development of tourism,the status of tourism consumers is increasingly important,which requires gradual improvement of relevant tourism laws and regulations.Taking Sanya,Hainan Province as the research subject,this paper investigates the protection of tourism consumers' rights and interests by analyzing the tourism legislation status at the district and municipal level in Sanya and drawing lessons from theoretical research and practical measures at home and abroad based on the former analysis.Meanwhile,we can improve the tourism legislation in Sanya in this field and better link up with higher-level laws with reference to this research so as to solidly guarantee the legitimate rights and interests of tourism consumers and make Sanya the favorite travel destination among tourists,thereby facilitating the prosperity and development of tourism in Sanya.This paper mainly embodies four part.The first part presents the basic theory and role of local tourism legislation,which is divided into two sections,the first of which firstly deals with the definition of the concepts of "tourism","tourism consumers" and "tourists' rights and interests";subsequently,it elaborates three important theories which guide the creation of this paper,namely,"tourism rights theory","consumer paramountcy theory" and the "balance of interests theory".The second section focuses on the protective effect of local tourism legislation on tourism consumers,as well as the contribution of local tourism legislation from the two aspects of "local legislation" and "the role of local legislation in protecting the rights and interests of tourism consumers".The second part hereof is to study the current situation and existing problems of tourism legislation in Sanya.In the first section,the status of tourism legislation in Sanya is analyzed in depth,including "existing legal resources","legislative system" and "legislative content".In the second section,the existing problems are sorted out and pointed out in detail.The third part refers to the legislation practice of tourist cities with advanced experience,which Sanya can draw lessons from.The fourth part is the countermeasures to improve the tourism legislation in Sanya.It mainly ponders on the problems summarized in the second part and refers to the theoretical knowledge mentioned in the first part and the experience drawn in the third part,thus perfecting the tourism legislation in Sanya.
