Research On Legal Supervision Of Autonomous Vehicles

Autonomous vehicles are the representatives of artificial narrow intelligence.While automatic driving technology promotes social progress,there are also certain social risks.In particular,Road Traffic Safety Law cannot effectively regulate them.The Road Traffic Safety Law has established the basic system of road traffic management in China with the three core elements of transportation,including vehicles,participants and roads.Autonomous vehicles have an impact on road traffic management in terms of vehicles,participants,including pedestrians and drivers,and roads,which seriously restricts the effectiveness of Road Traffic Safety Law.In order to maintain traffic order,the Road Traffic Safety Law must be perfected in three aspects:vehicles,participants and roads.In the aspect of vehicle safety regulation,it is first necessary to clarify the legal attributes of autonomous vehicles,formulate safety standards for autonomous driving technology,establish a safety performance testing system for autonomous vehicles,safeguard public safety,and promote industrial development.In the aspect of driving subject license,the legal meaning of the driving subject should be accurately defined,and the driving subject licensing system should be improved according to the development of the automatic driving technology.The type of driving license for autonomous vehicles should be added to the framework of the existing motor vehicle driving permit system,and duty of care should make a reasonable allocation in the law and strengthen the safety management of autonomous vehicles.In the aspect of the allocation of road rights,it is necessary to give the right to autonomous vehicles in the Road Traffic Safety Law,and to set the priority right of autonomous vehicles within a limited range,and also to appropriately limit road rights of the autonomous vehicles to guarantee reasonable allocation of resources.At this stage,China should establish an administrative supervision system for autonomous vehicles as soon as possible to achieve a balance between safeguarding public safety and promoting industrial development,to enhance the national core competitiveness.
