Rising in recent years,as China's aging population, criminal activities for the elderly,is also more and more active, including fraud crime itself and to the elderly for the elderly, especially the influence of the society as a whole, this kind of fraud make old people badly hurt both physically and mentally, moreover has led to the old man's suicide. However,it is a pity that there are very few research results on the fraud of the elderly at home and abroad, and such problems have not received enough attention from domestic and foreign scholars. In order to prevent such fraud incidents from happening again, this paper decided to use the research thinking of behavioral economics to deeply analyze the mechanism behind the fraud incidents of the elderly,so that people have a clear understanding of the principles behind these fraud incidents. In this paper, the probit model is used to conduct an empirical test on the viewpoints of this paper, and the empirical analysis of this paper verifies the core viewpoints of this paper, that is,whether the elderly are cheated is related to the loneliness of the elderly, and the stronger the loneliness of the elderly, the greater the possibility of the elderly being cheated. At the same time, this paper also verifies two hypotheses of this paper through empirical evidence. One is that there is an interactive effect between the physical health status of the elderly and loneliness, that is,the poorer the physical health status of the elderly, the stronger the effect of loneliness will be,and the elderly will fall into a fraud.Second, there is an interactive effect between the cognitive ability of the elderly and loneliness, that is,the poorer the cognitive ability of the elderly, the stronger the effect of loneliness will be,and the elderly will fall into a fraud. The two hypotheses also explain the logic behind the criminals' actions to some extent. At the same time, this paper also negates the view that the elderly in society can avoid being cheated by reducing social contact through analysis, and advocates that the elderly need to have more social interaction,so as to exercise their body and mind. This paper also puts forward its own opinions on both the individual and the government through the above research, hoping to prevent tragedies from happening again through this research, which is also the original intention of this paper.
