A Probe Into The Legal Mechanism Of The Protection Of Minors In China

The protection of minors has always been one of the most important tasks in China,but vicious violence such as school bullying has been reported frequently in recent years.Different from the past,the younger insults have a tendency to become younger,and because of their mental development,the means are cruel and reckless,the degree of serious harm that comes with it is unprecedented,and even more victims are suicidal because of long-term bullying.Under the seemingly strict protection system,minors are still frequently victimized,which brings great challenges to the school protection work of minors in China.It also reveals that there are many shortcomings in the legal protection mechanism of minors in China.This paper believes that primary and secondary schools,as the places with the most minors and the most close to study,should assume the necessary responsibilities in maintaining campus safety and training for underage students.Therefore,improving the legal system for the protection of minors' schools is of great practical value in preventing and controlling violence such as school bullying.In addition to the conclusion,this article is divided into six parts for exploration:the first part is based on the background and meaning of the topic,at the same time,it sorts out and analyzes the research status of minors' "school protection" related fields,and draws the direction and ideas of this research.The second part introduces and analyzes the typical incidents of infringement of minors in schools.The third part explores the problems in the protection work of minors through the above cases,for example,the school's responsibilities are not clear and lack of effective supervision,the school's emergency response to school bullying and other incidents,the judicial disciplinary measures are single,the school's educational function is not reflected,the lack of assistance for minor victims,and so on;The fourth part,based on the characteristics of current school bullying incidents,analyzes the causes of the current system's difficulties in practical operation from three aspects of legal system,administrative supervision and judicial relief guarantee.For example,the lack of special legislation,the lack of school bullying prevention mechanism,the failure of administrative intervention measures,judicial punishment mechanism,rescue security system is not perfect.The fifth part analyzes and draws on the mature foreign theory and practical experience.The sixth part combine theory in our country the truth,the effective mechanism of minors protection law school in our country run provides a perfect idea,such as conceive of special legislation,strengthening the administrative intervention bullying prevention mechanism,establishing the treatments of the school to participate in the education system,the establishment of a social forces to participate in the juvenile victim relief system such as train of thought.The author hopes that through the reform and improvement of the legal mechanism of school protection,the effective suppression of school bullying can be realized and the goal of campus safety can be effectively maintained.
