| Campus bullying is happening every day in a world of dangerous school security,and some of it is a very serious case,and the campus bullying is a constant concern for the whole society.In recent years,there has been a significant increase in the number of bullying incidents in our country and the tendency of the plots to become more serious,showing the characteristics of the younger age,the violence,the group and the diversity.However,based on the law of the limited factors such as hysteresis,emphasize the evidence,and our country on the age of special law,illegal and criminal behavior of persons under the age of around ten children,ten teenagers implementation abuse beating between 4 to 16 one full year of life,such as relatively mild damage behavior,are difficult to be investigated for criminal responsibility according to law,and even cannot be conducted mandatory detention,public security and civil liability shall be investigated for evidence lack the necessary support and is difficult to assess for the injury by bullies,so a considerable amount of bullying can only by the school and parents in the internal coordinate processing.To sum up,due to the low cost,little accountability,and the difficulty of obtaining evidence,some primary and middle school students have become more unruly in the implementation of campus bullying.The ministry of education in China since 2016 had dominated or other department issued a joint "about campus bullying special notice,on the" instructional advice on the prevention and treatment of primary and secondary students bullying and violence,would rise to the governance level against bullying.However,the theoretical research on school bullying in China is still in its infancy,and there is no data feedback mechanism for bullying in schools,and the legal provisions are almost blank.Specializes in this paper,especially primary and middle school students under the age of 18 years to implement body,speech and intentional or malicious network,spiritual isolation and other means to reach the purpose of bullying and insult bullying behavior,by comparing the Chinese and foreign anti bullying legislation present situation research,construct and perfect our legal countermeasures against bullying of primary and secondary schools,from elementary school the bullying of legislative,judicial,and policy reforms that several aspects of comprehensive control,establish the effective mechanism that bullying prevention and control,to achieve early detection and timely intervention,the purpose of effectively stop bullying. |
