Recruitment of civil servants is an important way for state organs to select talents and is an important system in the management of civil servants.At this stage,the recording degree of civil servants in China has been gradually established along with the development of the political and economic system,and has achieved certain results,attracting a large number of talents to apply for civil servants.Faced with such a large number of candidates,there are still some shortcomings in the rights and remedies of candidates in the civil service examinations in China at present,and the legitimate rights and interests of candidates are not effectively protected.Judging from the legislative and judicial practice,China has not paid much attention to the violation of the rights and interests of candidates in the recruitment of civil servants,and there are limited ways for candidates to make rights relief.Law:There is a right to have relief.Therefore,it is urgent to study and promote the rights relief system for candidates in civil servant recruitment,so as to safeguard the legitimate rights and interests of candidates and help to promote the continuous reform and progress of China's legal system.This paper analyzes the nature of the administrative behavior in the record of civil servants,analyzes the current situation of the rights of the candidates,and analyzes the existing remedies and their deficiencies,and then puts forward suggestions and suggestions for improving the rights relief in civil servant recruitment.Civil servants recruited candidates to provide reference and reference for maintaining their legitimate rights and interests.This article is divided into four parts:The first part is mainly the identification of the nature of the behavior of civil servants and the analysis of the value of rights relief.First of all,through the definition of administrative behavior in the administrative law circles at home and abroad to determine the nature of the behavior of civil servants in China;secondly,the value and significance of rights relief through the rights and the status quo of the candidates in the recruitment of civil servants.The second part mainly analyzes the administrative remedies of the infringement cases of candidates in the civil servant recruitment in the light of the relevant laws and regulations of the administrative law of our country and the actual situation of judicial practice,and refines the two categories of non-litigation relief and litigation relief.The third part mainly expounds the insufficiency and reasons of the rights relief in the recruitment of civil servants,specifically the inadequacies and causes of administrative appeals and accusations,the inadequacies and causes of administrative reconsideration relief,the inadequacies and causes of state compensation and the lack of administrative litigation relief.And the reason four dimensions are expanded.The fourth part is mainly to put forward suggestions and suggestions for improving the rights relief system in the recruitment of civil servants,including improving the non-litigation relief system in the recruitment of civil servants,improving the administrative litigation relief system in the recruitment of civil servants and exploring the establishment of guaranteeing the basic rights of citizens.Three aspects of the constitutional litigation system.
