Study On The Public Participation Mechanism In The Legislation Of The Local People's Congress In China

In the process of perfecting the socialist legal system in our country,local legislation is an important factor that can not be ignored.As a modern and democratic country,the public participation mechanism is the source of local legislative vitality in our country.It is inevitable to expand the scope and approach of public participation.In many local legislations in our country,various local people's congresses at various levels have conducted a wide range of public participation practices in recent years and have accumulated some experience and formed some public participation mechanisms in legislation.These mechanisms have drawn wide attention from all sectors of society and have also had some positive and positive impact on the quality of some of the legislatures.However,for our country,the research on the mechanism of public participation is just beginning,there are many shortcomings,such as the lack of enthusiasm of the public participation in practice,the lack of relevant specific operation and the legal system of supporting system.How to further improve the public participation mechanism,strengthen the supervision over the legislative process and improve the public opinion,communication and expression mechanism are all major challenges that all people's congresses in promoting the public participation in practice at this stage.Therefore,the study of the public participation mechanism in local legislation of our country and the perfection of the public participation guarantee mechanism in practice are of great significance to the current public participation legislative mechanism.This article discusses the public participation mechanism in the legislation of the local people's congress through four parts.The first part elaborates the historical development,practice,jurisprudence and reality basis of the public participation mechanism in the legislation of local people's congresses in our country.The second part studies the problems existing in the mechanism of public participation in the legislation of local people's congresses in our country.Through the investigation of the current situation of the public participation mechanism in the legislation of local people's congress in our country,this paper summarizes the shortcomings of a series of mechanisms.The third part is the experience that the public participation mechanism in foreign legislation is worth learning from.Through the relevant laws and regulations system of public participation in legislation in foreign countries,the effective mechanism of public participation in the United States and Japan and the good role played by the public participation mechanism in the U.S.and Japan legislation,the feasibility of using the public participation mechanism in foreign legislation as a reference for our NPC Experience to analyze.The fourth part is the countermeasures and suggestions of perfecting the public participation mechanism in the legislation of the local people's congress of our country.In the end,the article puts forward the feasible long-term mechanism according to the problems analyzed in the third part and the problems in reality.
