Research On Public Participation In Legislation Of Heilongjiang Provincial People's Congress

The 19 th National Congress of the Communist Party of China demanded that Scientific legislation,democratic legislation and law-based legislation should be promoted,in order to improve economic development and ensure the harmonious rule.All of these,such as broadening channels for the public to participate in the orderly legislation,mobilizing the enthusiasm of the public and extensively receiving suggestions from the public,play an important role in improving the construction of the rule of law and deepening the practice of administering the country by law.Especially in the legislation of the local people's congress,due to the strong pertinence and adaptability of the local laws and regulations formulated by the local people's congresses,it is even more necessary to remove insider trading and neglect departmental interests in the legislative process.Through the public's deep and effective participation,they can receive accurate opinions from the public.After more than three decades of legislative practice,the NPC and its standing committees have scientifically and democratically improved their legislation levels.However,there are still some prominent problems that affect the quality and effectiveness of public participation in the legislation of local people's congresses.Therefore,it is necessary to thoroughly summarize and reflect on the problems existing in the legislative practice of local people's congresses.This thesis employs the combination of theory with practice,mainly using positivism research,systematic analysis,comparative analysis and other specific methods.First of all,we sort out relevant concepts and theories in the legislative public participation of local people's congresses,which constitutes the foundation of this study.Secondly,we describe the factors that affect the components of public participation system and the effects of participation from the perspective of system theory.Then,through the gradual refinement of the overall elements,we recognize functionality of various parts,so as to find out the factors that have impact on the functionality of the whole system and optimize the integration effect.Taking the process of formulating the "Food Safety Regulations of Heilongjiang Province" as an example,we analyze and summarizethe status quo and existing problems of public participation in the legislation of Heilongjiang Provincial People's Congress in the above framework.Finally,the author chooses three representative examples of the legislation of the United States,the Peking Congress and the Guangdong Provincial People's Congress for comparative analysis.Their system possessing the characteristics of guaranteeing the public participation of the legislature,correctly handling the public opinions and improving the system and mechanism of the people's congress leading the legislation,provide useful experience for the NPC in Heilongjiang Province.Finally,this paper combines the practice of Heilongjiang Province,drafted a feasible plan to improve the effectiveness of public participation.This program proposes five countermeasures and suggestions for promoting public participation in the legislation of local people's congresses and improving the quality of local legislation.
